Today, I listened to the arguments at the Supreme Court (via C/SPAN). I haven’t practiced law in three decades, but you don’t need to be an active attorney to recognize a beatdown when you hear one. Had this been a boxing match, it would have been stopped on a TKO (technical knockout).
I’m going to go out on a limb: All (or nearly all) of the Trump tariffs will be overturned by SCOTUS as unconstitutional. It should be 9-0, but several of the justices have given up any pretense of being neutral, nonpartisan arbiters; my guess is 7-2 or (maybe) 6-3 will affirm the Court of Appeals decision in favor of overturning the tariffs. If you surveyed Constitutional Law professors, I bet it is close to 95% agree tariffs are the province of Congress (as per the Constitution, Article 3, Section 8), and that these Executive orders are unconstitutional.
Considering the plaintiffs have won at both trial (Court of Trade) and at the full en banc hearing in the DC Court of Appeals, this isn’t a big surprise. I suspect any company that paid an unconstitutional tariff will be entitled to a refund. Look at the companies that suffered the largest stock price damage in the first weeks of April; I don’t imagine consumers will be able to easily get a refund.
Perhaps Wall Street has overlooked this, but the market has caught on. It’s very likely (possible?) that a large part of the rally over the past 6 months was the market anticipating this outcome.

Surplus Energy Economics, How Wealth Dies, The Notional Value Trap
Just as growth in the “real” economy of material products and services has been decelerating towards contraction, so aggregates of financial wealth have carried on increasing relentlessly.
Since the widening disequilibrium between the monetary and the material must eventually crash the financial system, the probability is that notional wealth will reach its peak at the same moment at which the monetary system collapses.
We can see this unfolding effect in microcosm in the United Kingdom, where the most recent official calculation put national “net worth” at a near-record £12.2 trillion, or 450% of GDP. Yet you don’t need SEEDS analysis to know that the British economy itself is at an advanced stage of disintegration…
..What we have been exploring here is a paradox that is no paradox at all. The world will keep setting new wealth records until the financial system collapses.
Investors have lived with supportive intervention from the authorities ever since 1987, which means that very few of them have ever experienced anything else. Throughout this period – and certainly since official support became explicit in 2008 – the “momentum trade” has been the only game in town. It’s been like gambling in a casino where the house stacks the deck in favour of the punter.
So ingrained has this thinking become that there are likely to be many still determined to “buy the dip” even as the financial system goes finally into the blender. This, in short, is why wealth is destined to collapse – swiftly, not gradually – from an all-time peak.
Our necessary insight here is that, since any value contained in money exists only as a “claim” on a material economy that is now contracting, there must come a point of fatal disequilibrium between claim and substance.
The sheer scale and complexity of the aggregates of claim stock are now so extreme that the authorities will be powerless to backstop the next big crash.
It’s scant consolation to know that these enormous aggregates never, in any meaningful sense, actually existed in the first place.
Thus understood, it might not seem to matter all that much if aggregate (and individual) values collapse. Your house, for instance, will still fulfil its essential function of providing somewhere to live, even if its supposed value slumps from $1m to $200k. Even if you’d decided to sell at the highest price, buying a replacement would have been equally costly.
But this comfort only applies if you hadn’t used the property as security for a large mortgage.
And the financial system as a whole has done exactly that. Russia has already encircled these forces. If the Russians are able to capture (or kill) active-duty NATO member country troops, taking-up arms on the battle field, this will be the definitive proof Russia needs to show the world that the U.S. and NATO themselves are, in fact, “at war” with Russia.
Capturing or killing such active-duty forces would be a Casus Beli for Russia – cause for war – with the US and NATO.
So desperate is NATO to evacuate these troops, they sent two Blackhawk Helicopters – previously gifted to Ukraine – to try to hot-extract the troops from an active combat zone. Both helicopters landed, and were destroyed y the Russians. The extraction didn’t take place.
Now, the race is on to see if NATO can get their troops out before Russia captures or kills them; thereby making the Ukraine war, an actual war with NATO.

Burevestnik has surpassed all other known missiles in the world in terms of range. It also boasts high precision, achieved steadily within a pre-calculated timeframe.I believe foreign specialists were able to learn about these characteristics first-hand since during the testing of Burevestnik on October 21, a NATO reconnaissance vessel was continuously present in the trial zone. What I want to stress is that these technological breakthroughs do not come out of nowhere. It goes without saying that they represent the work and talent of many generations of our compatriots who started this research in the second half of the 20th century and persisted in their dedicated efforts.
Of course, we have also succeeded in developing other super-complex systems similar to Burevestnik and Poseidon, which demonstrates that research institutions, universities and schools, manufacturers and the economy as a whole have immense potential and opportunities in today’s world.
Let me make an important point. As I have already said, Burevestnik and Poseidon rely exclusively on domestically manufactured materials. In fact, a major effort to promote cooperation, involving many thousands of people, as I have already said, enabled us to create a real treasure trove of new materials, technologies, unmanned devices, software and digital solutions, and elements of the components base. By putting them to use, we can achieve breakthroughs not only in defence manufacturing, but also in many civilian sectors while carrying out multiple priority national projects and programmes.
This includes building small nuclear reactors for powering the Arctic zone and exploring near and deeper space, including powering the spacecraft we are developing right now for delivering heavy payloads. This could also be used in the future for the base on the Moon too.
By operating based on new principles and algorithms, the Poseidon project can facilitate efforts to improve unmanned devices, while also helping develop shipbuilding, navigation systems and unmanned navigation, including in the Arctic, while exploring the Trans-Arctic Transport Corridor, and along other routes.
The small size, weight, and volume of these new nuclear generators, along with their safety and reliability, allow for flexible use in creating power units for mineral extraction in hard-to-reach areas, including offshore Arctic fields, providing light and heat to remote regions and communities, and increasing the efficiency of underwater expeditions exploring the World Ocean.
The components and electronics developed for the Burevestnik and Poseidon will also be instrumental in creating powerful computers, as well as in the development of digital infrastructure, control, and communications systems.
I repeat, a cornerstone for the future has been laid that will define and enable our progress for decades to come. I know you are already building on this. A new generation of weapons and equipment is present not only in your plans, but also in your calculations, drawings, test rigs, and on your ranges. Nobody seems to be talking about this, but the ability to launch and hold off your nuclear weapons, means that when politics is dodgy between the USA and Russia, Russia can launch its Burevestniks, keep them in the air just off the USA coast (or inland in the USA) and then, if the USA POTUS sends out the message to launch, the Burevestniks will attack the US silos before the old US nuclear missiles can boot up and be ready to fire. Women abandoned the motherhood role in order to increase the family income in order for the family to be able to buy a house. Now even the average family cannot earn enough to afford just one of the houses owned by the oligarchy. Cheap plebs was the goal, they now have their cheap plebs and the middle class is disappearing, resulting in the west reverting to a feudal society.
The conservatives would not raise this issue as they hate to fight for workers’ rights.
