Trump Orders New FBI Probe Into Kavanaugh Following Senate Request (Ind.)

Donald Trump has ordered the FBI to carry out a fresh investigation into his nominee for the Supreme Court, after Republicans were obliged to delay a full confirmation vote after being blind-sided by one of their own senators. During a day of blurred and frequently confusing drama on Capitol Hill, the Senate Judiciary Committee on Friday voted 11-10 to approve Brett Kavanaugh for a confirmation vote in the full senate. But it did so, only after an 11th hour intervention from Jeff Flake, a senator from Arizona, who said his support in the later confirmation vote was dependent on the FBI being given a week to carry out an investigation into Mr Kavanaugh, the subject of sexual assault allegations from several women, all of which he denies.

“This country is being ripped apart here,” Mr Flake told the committee, after a vote scheduled for 1.30pm was delayed. “We ought to do what we can to make sure that we do all due diligence with a nomination this important.” Mr Flake’s deeds sent senior Republicans scrambling to decide how best to proceed. The senate’s Republican chairman, Chuck Grassley, who has long said he did not see the need for an additional investigation into Mr Kavanaugh, said it was the decision of Senate majority leader Mitch McConnell on when to hold the confirmation vote.

Within a matter of hours, Mr Grassley issued a statement saying he would ask the White House to request the FBI carry out an additional background check. Shortly afterwards, White House press secretary Sarah Huckabee Sanders released a statement from the president, which read: “I’ve ordered the FBI to conduct a supplemental investigation to update Judge Kavanaugh’s file. As the senate has requested, this update must be limited in scope and completed in less than one week.”

[..] Mr Flake may have been motivated to act by the words of two protesters who confronted him in a senate elevator after it was initially announced he would back Mr Kavanaugh. “What you are doing is allowing someone who actually violated a woman to sit on the Supreme Court. This is not tolerable. You have children in your family. Think about them. I have two children,” shouted one of the women, Ana Maria Archila. “I cannot imagine that for the next 50 years they will have to have someone in the Supreme Court who has been accused of violating a young girl. What are you doing, sir?”

The Return Of The Inquisition (Simon Black)

Senator Maize Hirono of Hawaii recently stated, “Not only do women like [Kavanaugh’s accuser], who bravely come forward, need to be heard, but they need to be believed.” By definition this is neither fair nor impartial, and turns the entire process into a Kangaroo Court… which is what the Senate has become. At a certain point yesterday, one Senator introduced multiple pieces of evidence on behalf of the accuser, including ‘expert reports’ that justify her inability to remember details from the assault. This is truly bizarre. These Senators are playing the role of judge in this matter. It seems impossible to do this while simultaneously acting as advocate for the accuser.

Another Senator sat smugly and sanctimoniously, leering down at Brett Kavanaugh and demanding explanations about code words for beer and flatulence that date back to Kavanaugh’s high school days. The fact that a United States Senator would actually consider this important evidence is an utter embarrassment. Another disgusting perversion of justice is that the United States Senate actually felt compelled to negotiate with the accuser about when/how she would testify. For example, the accuser wanted to prohibit certain questions, control who could/could not ask questions, determine the order of witness testimony, etc. This is simply NOT how the justice system is supposed to work.

[..] the saddest part – this manner of Inquisition… trial by social media… has now been condoned and advanced by the United States Senate, an institution whose members have ALL taken a solemn oath to support and defend the Constitution which they are now violating in the worst way. Clearly the Senate is no longer an assembly of kings… but a brood of bickering, immature weaklings. (The only resilience displayed has been from the accused and accuser, both of whom have had to endure insane public scrutiny.) There’s obviously an agenda here.

Perhaps some Senators are trying to win points with the #metoo movement for the upcoming elections. Or they’re intentionally blocking Kavanaugh simply because he is a Trump nominee. Whatever their reasons, they may be victorious in achieving their desired outcome. But it will be a Pyrrhic victory… for it will come at the expense of establishing a dangerous new standard that destroys the most important principles of Justice.

As deficits grow, liquidity is shrinking.

Without much fanfare or public discussion, Congress has decided to push the U.S. into deeper fiscal responsibility. Earlier this week, the House passed another Continuing Resolution (CR) to keep the government from “shutting down” prior to the mid-term elections. “The House on Wednesday passed an $854 billion spending bill to avert an October shutdown, funding large swaths of the government while pushing the funding deadline for others until Dec. 7. The bill passed by 361-61, a week after the Senate passed an identical measure by a vote of 93-7.” For almost a decade, Congress has failed to pass, and operate, underneath a budget.

Of course, without any repercussions from voters in demanding that Congress “does their job,” the path to fiscal insolvency continues to grow. The Committee For A Responsible Federal Budget made the following statement: “We’re pleased policymakers have likely avoided a shutdown and actually appropriated most of this year’s discretionary budget on time. But let’s not forgot that Congress did so without a budget and had to grease the wheels with $153 billion to pass these bills. That isn’t function; it’s a fiscal free-for-all.” Of course, with trillion-dollar deficits just around the corner, the negative impact from unbridled spending and debt increases will begin to reverse the positive effects from deregulation and tax reform.

The bigger problem with the $854 billion CR just passed by the House, and awaiting the President’s signature, is that it only covers spending from now until December. Such means that by the time we get the full 2019 budget funded, with the annual automatic increases still in place, we will be looking at more than $2 Trillion in annual spending. Such will require further increases in debt issuance at a time when there are potentially fewer buys of Treasuries readily available. As shown in the chart below, with the major Central Banks reducing their balance sheets simultaneously, some of the more major buyers are being removed from the market. “Central bank balance sheets have shrunk by over half-a-trillion dollars since March. This decrease in global liquidity – in the face of a global slowdown – raises the risk of policy mistakes much higher than is commonly assumed.” – ECRI

Junk Bonds Set For Record Winning Streak, High Grade Worst Since 2008 (ZH)

For the latest confirmation of the upside down market, look no further than corporate bonds where the riskiest, CCC-rated junk bonds are set to make a positive return for the 3rd consecutive year, the longest winning streak since records began in 1997. Not only have the lowest quality junk bonds, those rated CCC or lower, generating respectable absolute returns of 5.8% YTD, they have also outperformed higher quality debt with a 1% total return so far this month, according to Bloomberg and ICE data. Additionally, the lowest rated junk bonds have also outperformed the broader junk bond index, which has returned 1.9% YTD.

And while the key contributor to the outperformance of lowest-rated bonds is demand for, well, higher yielding paper as investors continue to chase returns, a key structural issue has been the lack of HY supply, which at $150 billion YTD is the lowest since 2009. Meanwhile, as investors scramble for any paper that promises a material yield, regardless of underlying fundamentals, investment grade corporate bond returns have, in the worlds of Bloomberg’s James Crombie “fallen from darling to deadbeat.”

Elon Musk Believed He Had Verbal Deal With Saudis To Take Tesla Private (WSJ)

Tesla Inc. CEO Elon Musk believes he had a verbal agreement in place with Saudi Arabia’s sovereign-wealth fund to help finance a plan to take the auto maker private, according to a person familiar with the matter, a contention that could preview how he will fight regulators’ accusation that he misled shareholders. Musk was sued Thursday by the Securities and Exchange Commission, which alleged that he misled investors when he tweeted last month that he had funding secured to lead a Tesla buyout. The agency, which is seeking to oust Musk from Tesla, said in its complaint that he “knew that he had never discussed a going-private transaction at $420 per share with any potential funding source.”

Musk believes the SEC’s effort is flawed in assuming that a written agreement and fixed price were necessary for a deal, the person said. Musk also thinks regulators aren’t taking into account that Middle Eastern businesses routinely operate using verbal agreements in principle, the person said. In addition, Musk has told people that he could have led a go-private transaction using his own stake in SpaceX, if major Tesla investors were on board. SpaceX is the privately held aerospace firm that Mr. Musk controls and is valued at tens of billions of dollars.

Labour Claims Theresa May’s Government ‘The Most Divided Ever’ (Ind.)

Labour has accused Theresa May of leading “the most divided government ever” as it released a dossier claiming a third of Conservative MPs have publicly criticised either the government or a Tory colleague within the last year. On the eve of the Conservatives’ annual conference, Labour said more than 100 Tory MPs have recently turned their fire on a colleague or on government policy. The report said 80 per cent of the attacks were directed at Ms May or her government, with 83 MPs having criticised one of the two. The dossier was released as a number of senior Conservatives spoke out against Ms May’s leadership and voiced fears about the prospects of the party.

Much of the criticism outlined in the Labour document relates to Ms May’s Chequers plan for Brexit, which has been widely condemned by both Eurosceptics and Remain supporters on the Tory benches. It has been called “unworkable” by Justine Greening, the pro-European former education secretary, while former Brexit minister Steve Baker said it could lead to a “catastrophic split” in the Conservative Party. Mike Penning, previously seen as an ally of Ms May, described the plan as “dead as a dodo”, and former cabinet minister Priti Patel said it would be “a disaster for our country”. Ms May is facing mounting pressure to ditch the proposals, which are also highly unpopular with Tory members and have been rejected by EU leaders.

Boris Johnson’s ‘Super Canada’ Alternative Brexit Plan Rubbished (G.)

Furious ministers rounded on Boris Johnson for suggesting the UK could renege on its Brexit agreements over the Irish border, calling it unworkable and criticising the former foreign secretary for denouncing agreements made while he was a cabinet minister. The Department for Exiting the European Union issued a defiant statement rejecting Johnson’s alternative, laid out in a 4,000-word Telegraph article, saying it was “not a workable or negotiable plan,” less that two days before the start of the Conservative party conference in Birmingham. Government sources mocked Johnson’s disavowal of the December withdrawal agreement, when he had been part of the cabinet that approved it, dismissing his intervention as “another very lengthy article which doesn’t offer any answers”.

Speaking ahead of the conference, May said the government was on the verge of a Brexit deal, despite admitting after the EU summit in Salzburg that the two sides remained some distance apart on customs and the Northern Irish border. “The right deal is close – and with it the opportunity to make life better for ordinary working people,” she said. But Johnson continued his public intervention with a series of television interviews – his first since quitting over Chequers – criticising the prime minister, warning May that she risked betraying the wishes of leave voters if she persisted with the Chequers deal but stopping short of calling her to go. Johnson told the BBC: “If you stick with Chequers, the electorate of this country will look at what we have produced and think how on Earth was that the outcome of voting leave.”

As deadlines approach and red lines are redrawn in the United Kingdom’s impending withdrawal from the European Union, it is imperative for the people of Britain to regain democratic control over a process that is opaque and ludicrously irrational. The question is: How? Democracy can never aspire to being more than a work in progress. Decisions made collectively must constantly be reappraised collectively in the light of new evidence. Yet, in the UK’s current circumstances, nothing would be more poisonous to democracy than revisiting Brexit by means of a second referendum.

Both sides, Leavers and Remainers, feel betrayed. Even though Brexit was meant to restore its sovereignty, Parliament has no real say in a process that will mark Britain for decades to come. The Scots and the people of Northern Ireland are hostages to a distinctly English feud that could do them serious damage. The young feel the old have hijacked their future, while the old feel that their accumulated wisdom and legitimate concerns are being ignored by insiders striking bad deals behind closed doors on behalf of vested interests. In short, British democracy is failing its latest and most stringent test.

But a fresh referendum cannot be the answer to the unfolding disaster triggered by the original referendum. In June 2016, a stark choice was available to the people of Britain: leave the EU or stay in. While one can question the wisdom of making such a collective choice via a referendum, the logical coherence of the enterprise was beyond dispute. Once the verdict came in, and the process stipulated by the Treaty of Lisbon’s Article 50 was triggered, no binary yes-or-no choice to steer Britain out of its mess became available. In fact, there are now at least five options that must be collectively appraised.

Facebook Says Nearly 50m Users Compromised In Huge Security Breach (G.)

Nearly 50m Facebook accounts were compromised by an attack that gave hackers the ability to take over users’ accounts, Facebook revealed on Friday. The breach was discovered by Facebook engineers on Tuesday 25 September, the company said, and patched on Thursday. Users whose accounts were affected will be notified by Facebook. Those users will be logged out of their accounts and required to log back in. “I’m glad we found this and fixed the vulnerability,” Mark Zuckerberg said on a conference call with reporters on Friday morning. “But it definitely is an issue that this happened in the first place. I think this underscores the attacks that our community and our services face.”

The security breach is believed to be the largest in Facebook’s history and is particularly severe because the attackers stole “access tokens”, a kind of security key that allows users to stay logged into Facebook over multiple browsing sessions without entering their password every time. Possessing a token allows an attacker to take full control of the victim’s account, including logging into third-party applications that use Facebook Login. The security breach comes at a time of significant strife for the social media company, which has faced mounting criticism over issues including foreign election interference, the flow of misinformation, hate speech, and data privacy.

Melting Arctic Ice Opens New Route From Europe To East Asia (AP)

A Danish-flagged cargo ship has successfully passed through the Russian Arctic, in a trial voyage showing that melting sea ice could potentially open a new trade route from Europe to east Asia. The Venta Maersk made the journey as a one-off trial, said Palle Laursen, the chief technical officer of A.P. Moller-Maersk, the world’s biggest shipping group. The ship, carrying a cargo of frozen fish, arrived in St Petersburg on Friday, after leaving Russia’s Pacific port city of Vladivostok on 22 August. “The trial allowed us to gain exceptional operational experience,” said Laursen, adding the ship had performed well in the unfamiliar environment.

The Northern Sea route could be a shorter journey for ships travelling from east Asia to Europe than the Northwest Passage over Canada because it will likely be free of ice sooner due to climate change. Experts say it could reduce the travel distance from east Asia to Europe from the 21,000 kilometres (13,000 miles) it takes to go via the Suez Canal, to 12,800 kilometres (8,000 miles). This would cut transit time by 10 to 15 days. It’s not the first time a cargo vessel has completed the Russian Arctic route, and Maersk underlined that the journey was “to gain operational experience in a new area and to test vessel systems”. “Currently, we do not see the Northern Sea route as a viable commercial alternative to existing east-west routes,” Laursen said.

Well, I Think We Found Our Supreme Court Justice Today… (F.)

Well, I think we found our Supreme Court Justice today. This should be very good news for Republicans, who seem to be in an awful hurry to get this done quickly. It doesn’t look like we have to wait any longer. Let’s all take a deep breath and step back for a moment. All crazy partisan politics aside, let’s consider the qualities a good justice should have. A good justice should be objective and fair-minded, not guided by strong preconceived opinions. A good justice should be empathetic, not focused on oneself. A good justice should be calm, not angry. A good justice should show grace under pressure, not be easily rattled. A good justice should be even-tempered, not short-tempered. A good justice should be thoughtful, not strident. A good justice should in the face of adversity show courage, not petulance.

There are classic lines from Shakespeare’s The Merchant of Venice about mercy and justice: The quality of mercy is not strained. It droppeth as the gentle rain from heaven Upon the place beneath. At the end of the day good leadership is about temperament. Having the kind of calm demeanor and even temperament that enables one to make sound thoughtful decisions under pressure. Not decisions that are reflexive, impulsive, angry or politically driven. When one thinks of the sea of strident bitter recriminations that have engulfed this whole Supreme Court nomination process, and the partisan political football the Supreme Court has become, it feels like we’ve completely lost sight of what a Supreme Court ought to be. It feels, sadly, like we as a nation are losing our way.

Well, cheer up, the good news at least is I think we found someone today with the right temperament to make a fine Supreme Court Justice. Her name is Christine Blasey Ford.

BIS’s Claudio Borio Says the World Economy Is About to Get Very Sick (Auerback)

When Claudio Borio speaks, the big bankers and investors, the economics profession, and senior policymakers listen quite carefully—even if his sentiments don’t reach the shores of the popular media. Borio, the chief economist for the Bank for International Settlements (BIS), the central bankers’ central bank, recently remarked on the fragility of the global economy, and suggested that we were on the verge of a significant relapsesimilar to the global crash experienced 10 years ago. Among the parallels he perceives: the proliferation of “collateralized loan obligations (CLOs), which are ‘close cousins’ of the infamous instruments known as collateralized debt obligations, or CDOs, and securities backed by residential mortgages,” the prevalence of which helped to crater the credit system in 2008.

Mindful as central bankers have been about the ready availability of liquidity, they have (as I have written before) omitted to “proactively… [charging] private market participants variable risk premiums commensurate with the risk of the underlying activity they are undertaking when providing credit.” Furthermore, Borio implies that the monetary and fiscal authorities expended excessive efforts toward restoring the status quo ante, instead of directing policy toward broader job creation and income generation, which would place the economy on sounder footing when the next downturn inevitably comes. Finally, the BIS’s chief economist also publicly mooted whether additional “medicine” of the kind that we used last time will be in sufficient supply to respond adequately when the next crisis emerges.

So is Dr. Borio correct in both his diagnosis and concomitant concern about the lack of readily available cures for the prevailing illness? And are there any key omissions in his analysis that could help to mitigate the inevitable relapse that he forecasts?

Italy Agrees High Public Spending Reforms In Potential Clash With EU (G.)

The Italian government agreed to a 2019 budget deficit target at 2.4% of GDP on Thursday night in a move that was celebrated by leaders but could bring the heavily indebted country into conflict with the European Union. The economy minister Giovanni Tria succumbed to pressure from the government’s two deputy prime ministers – Luigi Di Maio, the leader of the anti-establishment Five Star Movement (M5S), and Matteo Salvini, who heads up the far-right League – to increase the target in order to pay for election campaign promises such as a universal basic income, flat tax and pension reforms. Tria, an academic who is not affiliated to either party, had been seeking a more conservative 1.9% in order to avoid adding to Italy’s debt pile, which currently stands at around 131% of GDP, the second highest in the eurozone after Greece.

Speculation that Tria would resign has been denied. “There is an accord within the whole government for 2.4%, we are satisfied, this is a budget for change,” Di Maio and Salvini said in a joint statement. Di Maio wrote on Facebook that the agreement marked a historic day and was a victory for Italian citizens, not the government. The means-tested basic income, which will cost €10bn, was a key feature of his party’s election campaign. “For the first time in the history of this country we will erase poverty thanks to the basic income,” he said. “We will finally give a future to the 6.5 million people, who until now have lived in poverty and been completely ignored.”

Irish Banks’ Loan Losses Hit €140 Billion In 10 Years After Crash (IT)

The State’s main 11 banks and building societies racked up a total of €140 billion in loan losses in the decade since western Europe’s worst property crash, according to data compiled by The Irish Times. That equates to about three-quarters of the size of the Irish economy in 2008. The figures include bad-loan charges that lenders took between 2008 and 2017, as well as losses on the sale of batches of loans to overseas investment firms and the National Asset Management Agency (Nama). As Saturday marks the 10th anniversary of the snap guarantee of the Republic’s banking system, property developer Sean Mulryan and former Central Bank governor Patrick Honohan have warned in interviews with The Irish Times of risks facing the recovering housing market and State finances.

The guarantee of six Dublin-based lenders would cost taxpayers €64 billion in bailouts and tip the State into an international bailout. Foreign-owned Bank of Scotland (Ireland), Ulster Bank and KBC Bank Ireland also required multibillion-euro capital injections from their parents during the financial crisis. The 11 banks’ net loan losses over the past decade amount to €134.2 billion – or 25 per cent of their total 2008 loans – according to the data, compiled from banks’ annual reports and regulatory filings. [..] Only five of the original lenders remain as standalone companies, as the State continues to grapple with the legacy of the crash. Housebuilding is running at half of estimated annual demand for 35,000 homes and banks are still dealing with high levels of distressed loans.

Janet Yellen Says It’s Time For “Alarm” As Loan Bubble Runs Amok (ZH)

As rates move higher like they are now, the loans – whose interest rates reference such floating instruments as LIBOR or Prime – pay out more. As a result, as the Fed tightens the money supply, defaults tend to increase as the interest expenses rise and as the overall cost of capital increases. And because an increasing amount of the financing for these loans is done outside of the traditional banking sector, regulators and agencies like the Federal Reserve aren’t able to do much to rein it in. The market for leveraged loans and junk bonds is now over $2 trillion. Escalating the risk of the unbridled loan explosion, none other than Janet Yellen – who is directly responsible for the current loan bubble – recently told Bloomberg that “regulators should sound the alarm. They should make it clear to the public and the Congress there are things they are concerned about and they don’t have the tools to fix it.”

As we noted recently, the risks of such loans defaulting are obvious, including loss of jobs and risk to companies on both the borrowing and the lending side. Tobias Adrian, a former senior vice president at the New York Fed who’s now the IMF’s financial markets chief, told Bloomberg: “…supporting growth is important, but future downside risks also need to be considered.” He also stated that regulators had “limited tools to rein in nonbank credit”. But you’d never know this by listening to the Federal Reserve. According to Fed chairman Jerome Powell, during his press conference Wednesday, the Fed doesn’t see any risks right now. Powell said that “overall vulnerabilities” were “moderate”. He also stated that banks today “take much less risk than they used to”.

Why Do Debt Crises Come in Cycles? (Dalio)

If you understand the game of Monopoly®, you can pretty well understand how credit cycles work on the level of a whole economy. Early in the game, people have a lot of cash and only a few properties, so it pays to convert your cash into property. As the game progresses and players acquire more and more houses and hotels, more and more cash is needed to pay the rents that are charged when you land on a property that has a lot of them. Some players are forced to sell their property at discounted prices to raise that cash. So early in the game, “property is king” and later in the game, “cash is king.” Those who play the game best understand how to hold the right mix of property and cash as the game progresses.

Now, let’s imagine how this Monopoly® game would work if we allowed the bank to make loans and take deposits. Players would be able to borrow money to buy property, and, rather than holding their cash idly, they would deposit it at the bank to earn interest, which in turn would provide the bank with more money to lend. Let’s also imagine that players in this game could buy and sell properties from each other on credit (i.e., by promising to pay back the money with interest at a later date). If Monopoly® were played this way, it would provide an almost perfect model for the way our economy operates. The amount of debt-financed spending on hotels would quickly grow to multiples of the amount of money in existence.

Down the road, the debtors who hold those hotels will become short on the cash they need to pay their rents and service their debt. The bank will also get into trouble as their depositors’ rising need for cash will cause them to withdraw it, even as more and more debtors are falling behind on their payments. If nothing is done to intervene, both banks and debtors will go broke and the economy will contract. Over time, as these cycles of expansion and contraction occur repeatedly, the conditions are created for a big, long-term debt crisis.

Elon Musk Tore Up Last Minute SEC Settlement, Decided To Fight Instead (ZH)

To many it was clear from the beginning: “It’s an easy case,” said Charles Elson, director of the John L. Weinberg Center for Corporate Governance at the University of Delaware. “He said in the tweet he had financing, and apparently he didn’t. … It’s about as straightforward as you can get.” And on Thursday afternoon, the SEC confirmed that indeed just those two words blasted to the entire world and contained in Elon Musk’s infamous “funding secured” tweet – it would emerge just days later that funding was not, in fact, secured- would serve as the basis for a securities fraud litigation against Elon Musk; and while Tesla wasn’t named in the suit as a defendant, the SEC is seeking to bar Musk, Tesla’s largest shareholder and its top executive, from serving as an officer or director of any U.S. public company.

It almost didn’t happen that way: according to the WSJ, the SEC complaint only came after a last-minute decision by Musk and his lawyers to fight the case rather than settle the charges. The SEC had crafted a settlement with Mr. Musk—approved by the agency’s commissioners—that it was preparing to file Thursday morning when Mr. Musk’s lawyers called to tell the SEC lawyers in San Francisco that they were no longer interested in proceeding with the agreement, according to people familiar with the matter. After the phone call, the SEC rushed to pull together the complaint that it subsequently filed, the people said. Considering that this is an open and shut case, one wonders if Musk was once again on drugs when he decided that instead of settling, he would fight the charges. Or he simply saw the “playbook” and decided to roll the dice…

In any case, a fighting Elon is just what the SEC – its reputation in tatters after years of not pursuing “big name” stock manipulators – needs to restore its image. The case ranks as one of the highest-profile civil securities-fraud cases in years. Its filing less than two months after the Aug. 7 tweets by Mr. Musk also marks an unusually rapid turnaround by an agency that has been under fire for its perceived failure to promptly bring significant cases in the financial crisis and other episodes. “It means there was not that much investigation they needed to do to get comfortable that it was a case they should bring, but also a case they can win,” said Michael Liftik, a former SEC enforcement lawyer now at Quinn, Emanuel, Urquhart & Sullivan LLP.

Corbyn Talks With EU Officials Spark Fresh No-Deal Brexit Fears (G.)

Jeremy Corbyn has sparked fresh fears in Brussels of a no-deal Brexit after saying during talks with senior EU Brexit officials that he will vote down anything that fails to deliver the same benefits as membership of the single market and customs union. The Labour leader spent two hours with Michel Barnier, the EU’s chief negotiator, and Martin Selmayr, the most senior official in charge of planning for a cliff-edge Brexit. Emerging from the European commission headquarters, Corbyn said Barnier “was interested to know what our views are in the six tests”, referring to the criteria Labour has said must be met to ensure its MPs back a deal. The EU is increasingly concerned that the UK parliament will vote down any deal put forward by Theresa May.

One of Labour’s tests is that an agreement must offer the “exact same benefits” as membership of the single market and customs union. The Labour leader had initially planned a low-key visit to Brussels to attend the naming of a square in the Belgian capital in honour of the murdered Labour MP Jo Cox. It is understood, however, that the EU’s most senior officials were anxious to hear directly from Corbyn about his party’s plans, and invited him for a session of talks. After meeting Barnier and Selmayr, who is the secretary general of the European commission and in charge of no-deal planning, Corbyn insisted he was “not negotiating” but that there was an informal agreement that both sides would continue to talk.

Ecuador’s president said Wednesday that his country and Britain are working on a legal solution for Julian Assange to allow the Wikileaks founder to leave the Ecuadorian Embassy in London in “the medium term.” President Lenin Moreno told The Associated Press that Assange’s lawyers were aware of the negotiations. He declined to provide more details because of the sensitivity of the case. [..] Moreno said his country will work for Assange’s safety and the preservation of his human rights as it seeks a way for him to leave the embassy. “Being five or six years in an embassy already violates his human rights,” Moreno said on the sidelines of the UN General Assembly. “But his presence in the embassy is also a problem.”

Seattle Judges Throw Out 15 Years Of Marijuana Convictions (BBC)

Judges in Seattle have decided to quash convictions for marijuana possession for anyone prosecuted in the city between 1996 and 2010. City Attorney Pete Homes asked the court to take the step “to right the injustices of a drug war that has primarily targeted people of colour.” Possession of marijuana became legal in the state of Washington in 2012. Officials estimate that more than 542 people could have their convictions dismissed by mid-November. Mr Holmes said the city should “take a moment to recognise the significance” of the court’s ruling. “We’ve come a long way, and I hope this action inspires other jurisdictions to follow suit,” he said. Mayor Jenny Durkan also welcomed the ruling, which she said would offer residents a “clean slate.” “For too many who call Seattle home, a misdemeanour marijuana conviction or charge has created barriers to opportunity – good jobs, housing, loans and education,” she said.

Austrian Fruit Grower Sentenced To Prison Over Bee Deaths (AFP)

An Austrian fruit grower was handed a rare prison sentence Wednesday for having illegally spread an insecticide which led to the deaths of dozens of neighbouring bee colonies. The 47-year-old man had spread a powerful insecticide called chlorpyrifos over his trees in the Lavanttal area of Carinthia province, at a time when their blossoms were still attracting bees. More than 50 colonies belonging to two neighbouring apiarists perished. The court in the city of Klagenfurt found the fruit grower guilty of “deliberately damaging the environment”, pointing to his experience and role in training others in his field as evidence that he knew the consequences of his actions.

He was sentenced to a year in prison, of which four months will be without probation. Ordered to pay more than 20,000 euros ($23,500) in compensation, he said he will appeal. The court said it hoped the sentence would serve as a deterrent and to remind others that the “use of pesticides needs to strike a balance between the environment and economics”. The widespread use of pesticides has been blamed for a steep rise in deaths among bees and other pollinating insects. In April the EU voted to outlaw the use of certain pesticides from the neonicotinoid family blamed for killing off bee populations.

Orca ‘Apocalypse’: Half Of Killer Whales Doomed To Die From Pollution (G.)

At least half of the world’s killer whale populations are doomed to extinction due to toxic and persistent pollution of the oceans, according to a major new study. Although the poisonous chemicals, PCBs, have been banned for decades, they are still leaking into the seas. They become concentrated up the food chain; as a result, killer whales, the top predators, are the most contaminated animals on the planet. Worse, their fat-rich milk passes on very high doses to their newborn calves. PCB concentrations found in killer whales can be 100 times safe levels and severely damage reproductive organs, cause cancer and damage the immune system. The new research analysed the prospects for killer whale populations over the next century and found those offshore from industrialised nations could vanish as soon as 30-50 years.

Among those most at risk are the UK’s last pod, where a recent death revealed one of the highest PCB levels ever recorded. Others off Gibraltar, Japan and Brazil and in the north-east Pacific are also in great danger. Killer whales are one of the most widespread mammals on earth but have already been lost in the North Sea, around Spain and many other places. “It is like a killer whale apocalypse,” said Paul Jepson at the Zoological Society of London, part of the international research team behind the new study. “Even in a pristine condition they are very slow to reproduce.” Healthy killer whales take 20 years to reach peak sexual maturity and 18 months to gestate a calf.

PCBs were used around the world since the 1930s in electrical components, plastics and paints but their toxicity has been known for 50 years. They were banned by nations in the 1970s and 1980s but 80% of the 1m tonnes produced have yet to be destroyed and are still leaking into the seas from landfills and other sources.

Well, it’s Kavanaugh day, and yesterday both sides did what was expected: double down. New allegations, denials, talk of restraining orders, gang rapes that went unreported, it was a circus. No telling what will happen today.

The Senate Judiciary Committee on Wednesday night released a time of their efforts to responded to various accusations against Supreme Court nominee Brett Kavanaugh – including two men who say they they were the basis for the “groping” allegation. The claims also include a new allegation from a San Diego woman who alleges that Kavanaugh and others raped her in the backseat of a car, though it does not specify the place, date or identities of the alleged accomplices. [..] earlier Wednesday, another Kavanaugh accuser – Julie Swetnick, had an ominous cloud of doubt cast over her allegation that the Supreme Court nominee and a friend were operating a date-rape “gang bang” operation at 10 high school parties she attended as a legal adult three years older than Kavanaugh (yet didn’t report once).

Politico reports that Swetnick’s ex-boyfriend, Richard Vinneccy – a registered Democrat, took out a restraining order against her, and says he has evidence that she’s lying. “Right after I broke up with her, she was threatening my family, threatening my wife and threatening to do harm to my baby at that time,” Vinneccy said in a telephone interview with POLITICO. “I know a lot about her.” -Politico. “I have a lot of facts, evidence, that what she’s saying is not true at all,” he said. “I would rather speak to my attorney first before saying more.” Avenatti called the claims “outrageous” and hilariously accused the press of “digging into the past” of a woman levying a claim against Kavanaugh from over 35 years ago. Meanwhile, Swetnick has now been linked to Blasey Ford – as she utilized the law firm run by Ford to sue her previous employer, New York Life Insurance Co. for sexual harassment.

Argentina Gets Biggest Loan In IMF’s History At $57 Billion (G.)

Argentina has received the biggest loan package ever from the IMF, aimed at shoring up the country’s ailing finances: a whopping $57.1bn that will be disbursed over the next three years. “This is the biggest loan in the history of the IMF,” said the fund’s director, Christine Lagarde, on Wednesday as the final loan agreement was announced in New York. The loan – $15bn of which has already been received by Argentina – comes with stringent conditions, including a commitment to a zero deficit for 2019. Argentina had initially secured $50bn in a deal worked out in June after the South American country was battered by a currency crisis, a run on the peso and double-digit inflation. The economy minister, Nicolás Dujovne, said that at the last minute the IMF agreed to increase the lending package by $7.1bn.

Lagarde said that as part of the deal, Argentina’s central bank had agreed to intervene in currency markets only in case of extreme circumstances and that the new amount would help Argentina’s government face its challenges. The agreement will only allow Argentina’s central bank to intervene to stabilize its currency if the peso depreciates below 44 pesos to the dollar. It is currently at 39 pesos to the dollar after losing 50% of its value since the start of the year. The deal was announced just a day after the president of Argentina’s central bank, Nicolás Caputo, resigned unexpectedly, reportedly after disagreements with the IMF’s guideline limiting the bank’s future intervention to rescue the peso. Thousands of Argentinians joined in a nationwide strike on Tuesday to protest against economic turmoil and Mauricio Macri’s austerity measures.

The Next Financial Crisis Will Hit In 12-24 Months – Griffin (ZH)

With Ray Dalio predicting that the US has about 2 years until the next recession, earlier today the head of hedge fund Citadel, Ken Griffin, echoed the Bridgewater founder and predicted that there are “at least 18-to-24 months left in the market rally”, thanks to the “giant adrenaline shot” of the U.S. tax overhaul. Speaking at the Bloomberg Global Business Forum in New York Wednesday, Griffin said that “we are in this debt-fueled buying binge.” He said that the U.S. economy is “running hot now” thanks to President Trump’s actions: “The Trump policies, whether deregulation or tax reform, are certainly pushing corporate America to go, go, go,” he said, citing low unemployment and meaningful wage growth.

That’s the “good” news. The bad new: the artificial “binge” that will extend what is already the longest bull market of all time is “laying the seeds of the next financial crisis”, said Griffin. And what may come as a surprise to many, Griffin admitted that that he’s already managing his fund for the next economic downturn. “My position today is very much focused on managing the tail risks for that… we are late in the cycle, the animal spirits have been unleashed and when these correction occur they happen with very little notice”, he said.

In terms of specific crisis catalysts, the hedge fund manager said his biggest worry is the European Union, where individual nations like Italy and Spain can’t print euros to rescue their own economies. “Every crisis in the West for the last 50 years has been ultimately solved by intervention of governments,” he said. “There has been a huge sea change that has taken place, which is in the EU, the individual governments can no longer issue debt in their own currency.” And thanks to Brussels’ monetary strait-jacket, the ability of “those countries as sovereigns to rescue their financial system in the next crisis is greatly diminished or not even there,” he said.

Macron Rejects Trade Deals With Countries Outside Paris Climate Accord (Ind.)

Emmanuel Macron has announced France will no longer accept “commercial agreements” with countries that do not “respect” the Paris Climate Accord during a fiery speech at the United Nations General Assembly. The French president called for the upholding of trade rules that “guarantee fair competition on equal footing” during his Tuesday speech, following a Monday afternoon meeting with Donald Trump and the US president’s speech on Monday morning. Mr Macron appeared defiant towards Mr Trump, suggesting he’d no longer negotiate trade deals with the US after its withdrawal from the climate agreement last year.

“We will no longer sign commercial agreements with powers that do not respect the Paris accord,” Mr Macron said without directly referencing Mr Trump or the US. The high-profile speech arrived a day after Mr Macron met with Mr Trump for a discussion involving trade. Officials from both sides described the meeting as “constructive”. The US is now reportedly the only nation in the world which remains opposed to the Paris Agreement, after Mr Trump decided to pull out of the accord in 2017.

The Labour leader offers no solution to the problems of Brexit, but that doesn’t matter. He knows all he has to do is look the part, sound the part and wait for the desire for change to come to him

It may well be that claims the Labour Party has been turned into a personality cult are not completely fair, and never before has Jeremy Corbyn worked harder to counteract this unjust narrative than when he, Corbyn, stood on stage before his leader’s speech, joining in with the crowds as they chanted “Oooaaah Jeremy Corrrr-byn”. They held aloft scarves reading “Oh Jeremy Corrr-byn”. They sang the words “Oaaaah Jeremy Corr-byn,” and there, both on the stage and towering above on gigantic television screens, Corbyn mouthed along to the song, of which 66 per cent of the lyrics are his own name. To Corbyn’s credit, it certainly placed on proceedings a Waco siege-style edge he would not otherwise have engendered through the power of oratory alone.

As he descended into a spiral of circular arguments on the “mainstream media”, furtive glances were made at the door, wondering when special forces might finally storm the place and liberate the captives. There was no clearer evidence of the civil war that still hides in plain sight in the party than the fact that its deputy leader, the now seven stone lighter Tom Watson, did not address the conference from its main stage. But it would be nice to think his contribution to the party did not go entirely unacknowledged as he led the shadow cabinet on to the stage to the sound of the Liverpool People’s Choir singing “He Ain’t Heavy, He’s My Brother”.

UK Appoints Food Supplies Minister Amid Fears Of No-Deal Brexit (G.)

The government has appointed a minister to oversee the protection of food supplies through the Brexit process amid rising concerns about the effect of a no-deal departure from the European Union. The MP David Rutley, a former Asda and PepsiCo executive, was handed the brief at the Department for Environment, Food and Rural Affairs earlier this month. Defra said that Rutley, who once ran home shopping and e-commerce businesses at Asda, was merely taking on responsibilities already held by other ministers. He said: “It is an honour to join the Defra ministerial team at such an important time. I am determined to ensure that we fully realise the opportunities of leaving the EU.” Food industry insiders welcomed his appointment after warnings that delays of only half an hour at UK ports and the Irish border would risk one in 10 British firms going bankrupt.

One food industry business leader said: “The issue at the ports is a big threat. The UK always has been a net importer of food. If the ports don’t work then exporters will be struggling and importers will have a challenge too.” The executive said that while some food manufacturers were already setting aside additional supplies, stockpiling was not possible for products with a short shelf life, such as milk or vegetables. Another industry insider said the appointment of Rutley was “totally welcome”. They added: “There has been a level of naivety that people can stockpile food which is completely impossible and shows a misunderstanding of how the supply chain works. We would welcome someone genuinely informed and engaged.”

No-Deal Brexit ‘Would Stop British Farming Exports For Six Months’ (G.)

The National Farmers Union has warned of “catastrophic” consequences for the industry if there is no Brexit deal, after being warned by the EU that the UK faces a six-month wait to be certified as an approved third-country supplier. This would be a major setback to the food and drink sector, where exports to the EU are worth £13.2bn a year. The NFU says it has been told informally that although Britain is in complete regulatory alignment with the EU, if there is no deal, the same health checks countries such as China and the US undergo will apply to UK suppliers. “What we are talking about in effect is a six-month trade embargo until such time we can get the product in, from that point we will face the European’s external tariff wall meaning we will be priced out of the market,” said the NFU’s director general, Terry Jones.

It has been told that 6,000 meat processing plants that export to the EU will have to undergo individual audits by British authorities. These will then be checked by EU officials and then put to a standing veterinary committee for approval, a process that the NFU has calculated will take six months “at a conservative reading”. These checks will also be conducted on any other companies supplying food and drink to the EU, including those exporting bottled water, honey, jam, dairy and other fresh foods. “‘No deal is unpalatable and catastrophic for the industry and the more we hear, the more certain we are that our lines all along are right,” said NFU president, Minette Batters.

UK Could Use Brexit To Avoid EU Ban On Antibiotics Overuse In Farming (G.)

UK farmers could be allowed to use powerful antibiotics in ways soon to be banned by the European Union, after the government was accused of using Brexit to avoid implementing tougher rules on animal health. New rules aimed at curbing overuse of the drugs are being brought in by the European commission, but they will not come into effect before the Brexit cut-off date in March. The Guardian understands that government animal health experts have been advising vets and farmers they will therefore not have to implement the change. A divergence from EU rules could allow farmers and vets in the UK to dose healthy animals through their feed, as well as those diagnosed with illnesses – while EU farmers will be prevented from doing so.

Campaigners say this is irresponsible misuse of antibiotics that can lead to resistance and should be stopped in line with European rules. At an event this summer held by the UK’s Veterinary Medicines Directorate (VMD), which regulates farm antibiotics, the VMD’s director of operations, Paul Green, said the UK would implement the new EU regulations “as fully as we see fit … there may be some clauses we wish to omit [or] alter”. According to a person present at the event, Green then went on to say the government would allow farmers in some circumstances to continue to mix antibiotics in feed and drinking water to groups of animals for disease prevention.

Antibiotic use in farming is controversial; livestock account for the majority of antibiotics consumed, and overuse on herds and flocks can build up resistant bacteria that can spread to humans. Rules on the medicines have been toughened by the EU over the past decade. Under the EU’s planned improvements, it would no longer be possible for vets and farmers to mix antibiotics with feed to be given to large numbers of animals at a time, except under exceptional circumstances. This is seen as essential to cutting the overuse of antibiotics, as currently whole herds or flocks can be treated at once because of one sick animal.

The government is coming under pressure from potential trade partners not to adhere to stringent EU animal welfare standards after Britain leaves the EU, in order to open up the UK market to imports from countries with weaker regulations. The US Department of Agriculture, which has a strong influence on trade deals, has been working on plans that would allow groups of healthy animals to be dosed with antibiotics, against World Health Organization guidelines. These plans could play a key part in future trade with the US.

How UN Scientists Are Preparing For The End Of Capitalism (Nafeez Ahmed)

Capitalism as we know it is over. So suggests a new report commissioned by a group of scientists appointed by the UN secretary general. The main reason? We’re transitioning rapidly to a radically different global economy, due to our increasingly unsustainable exploitation of the planet’s environmental resources and the shift to less efficient energy sources. Climate change and species extinctions are accelerating even as societies are experiencing rising inequality, unemployment, slow economic growth, rising debt levels, and impotent governments. Contrary to the way policymakers usually think about these problems these are not really separate crises at all. These crises are part of the same fundamental transition. The new era is characterised by inefficient fossil fuel production and escalating costs of climate change.

Conventional capitalist economic thinking can no longer explain, predict or solve the workings of the global economy in this new age. Those are the implications of a new background paper prepared by a team of Finnish biophysicists who were asked to provide research that would feed into the drafting of the UN Global Sustainable Development Report (GSDR), which will be released in 2019. For the “first time in human history”, the paper says, capitalist economies are “shifting to energy sources that are less energy efficient.” Producing usable energy (“exergy”) to keep powering “both basic and non-basic human activities” in industrial civilisation “will require more, not less, effort”.

At the same time, our hunger for energy is driving what the paper refers to as “sink costs.” The greater our energy and material use, the more waste we generate, and so the greater the environmental costs. Though they can be ignored for a while, eventually those environmental costs translate directly into economic costs as it becomes more and more difficult to ignore their impacts on our societies. And the biggest “sink cost”, of course, is climate change: “Sink costs are also rising; economies have used up the capacity of planetary ecosystems to handle the waste generated by energy and material use. Climate change is the most pronounced sink cost.”

1% Of Greeks Owe 90% Of Tax Arrears To State (K.)

The vast majority of state debtors (93.3 percent) owe amounts of up to 10,000 euros each, while just 1 percent are behind 90 percent of total debts to the state. This is according to data processed by the Independent Authority for Public Revenue that was published in Parliament following a question put to the finance minister. In total, about 3.8 million taxpayers and enterprises have arrears to the Greek state that add up to 101.5 billion euros, most of which have been run up since Greece resorted to the bailout mechanisms.

Data indicate that some 3.6 million Greeks owe up to 10,000 euros each, totaling 3.7 billion euros. About another 240,000 people owe 10,000-100,000 euros, totaling 6.6 billion euros, while major debtors number 41,232 but owe a total of 91.2 billion euros to the state. Notably, about a third of the debtors’ arrears to the state, some 33 billion euros, concerns fines concerning corporate taxation, that have a low collection rate. One of the reasons for this low rate is the particularly heavy fines imposed in the past, which have led to the closure of several enterprises.

World’s Wetlands Disappearing Three Times Faster Than Forests (AFP)

Wetlands, among the world’s most valuable and biodiverse ecosystems, are disappearing at alarming speed amid urbanisation and agriculture shifts, conservationists said Thursday, calling for urgent action to halt the erosion. “We are in a crisis,” Martha Rojas Urrego, head of the Ramsar Convention on Wetlands, told reporters in Geneva, warning of the potential devastating impact of wetland loss, including on climate change. The convention, adopted in the Iranian city of Ramsar nearly a half-century ago, on Thursday issued its first-ever global report on the state of the world’s wetlands.

The 88-page report found that around 35 percent of wetlands — which include lakes, rivers, marshes and peatlands, as well as coastal and marine areas like lagoons, mangroves and coral reefs — were lost between 1970 and 2015. Today, wetlands cover more than 12 million square kilometres (4.6 million square miles), the report said, warning that the annual rates of loss had accelerated since 2000. “We are losing wetlands three times faster than forests,” Rojas Urrego said, describing the Global Wetland Outlook report as a “red flag”. While the world has been increasingly focused on global warming and its impact on oceans and forests, the Ramsar Convention said wetlands remain “dangerously undervalued”.

Directly or indirectly, they provide almost all of the world’s consumption of freshwater and more than 40 percent of all species live and breed in wetlands. Animals and plants who call wetlands home are particularly vulnerable, with a quarter at risk of extinction, the report said. Wetlands also provide a livelihood for more than one billion people, while mitigating floods and protecting coastlines. They are also a vital source of food, raw materials and genetic resources for medicines.

Axios reporter Jonathan Swan “broke” the story yesterday morning that Rod Rosenstein was going to resign before he would be fired, and he was on his way to the White House for that. Just about every would-be journalist in the US followed suit with speculation and ‘updates’ by anonymous sources either close to the White House or to Rosenstein.

Through the day it became clear that Swan’s entire story was pure speculation (though he just published an alleged resignation letter), and at the end of the day Rosenstein is still the Deputy AG, scheduled for a talk with Trump on the entire matter on Thursday. In short, Jonathan Swan dented Axios’ credibility by more than he will admit. So who has any credibility left by now? It’s not a long list anymore. Where can you get your news? Not where you used to.

Several voices volunteered that the White House had pumped the Rosenstein story in order to deflect attention from the Kavanaugh narrative. That made little sense: why would they do that? There may be some who think that Kavanaugh means a whole lot of trouble from Trump, but are they really paying attention, or merely thinking wishfully?

Kavanaugh himself didn’t look all that destroyed in his interview last night. And he made a very bold move: he said he was a virgin until well past high school. All it would take to break down that claim is one woman to step forward and say she had sex with him. And if he did have consensual sex even just once, nothing to do with assault, he’d still be exposed as a liar, so why make such a claim unless it’s true?

All this puts the allegations made against him in an eery light. Christine Blasey Ford’s story looked shaky from the start, because of all the things she said she couldn’t remember, but many people were granting her the benefit of the doubt. Then Deborah Ramirez added an allegation that if anything looked even less coherent. Even the New York Times could find no-one to corroborate her story, and she herself couldn’t, either.

Now, for all we know Kavanaugh may have been an adolescent monster, but we would still need proof of that before we nail him to a cross, or, worse still, keep him off the Supreme Court. Which is, obviously, what got the whole circus started.

 

Thursday will be yet another eventful day in the guaranteed to be always entertaining presidency of Donald Trump, and we wonder in eager anticipation how Axios and all the other news outlets will cover the events. Their Kavanaugh narrative looks shot right now, but we’d expect another woman, or two, or ten, to pop up with inflammatory tales.

Look for the one about consensual sex, that would seem to have a better chance than another assault with a penis chapter, and he set it up himself last night by his virgin declaration. Also, look for desperate attempts to smear the judge. There are still many people in Washington and beyond who really really don’t want him confirmed.

But then, everything they tried so far has backfired, even if that’s not what they see. That same thing may well happen in the Rosenstein saga. It’s no secret, never has been, that Trump has different opinions than Rosenstein, or for that matter Jeff Sessions, have on several matters. But they’re both still in their jobs.

Trump appointed Rosenstein, and he appointed Sessions, who turned around and recused himself from the Russian collusion case, putting Rosenstein in charge of that. Rosenstein appointed former FBI chief Robert Mueller as Special Counsel, though it was obvious from miles away that the FBI was heavily involved in the case.

Now, after all the Strzok/Page mails and the Andrew McCabe bumbling, we know that Robert Mueller, after almost two years, still hasn’t found any proof of collusion. We know this because he hasn’t presented any, which he would have been obliged to do if he had any, simply because the allegation of working with a foreign government to undermine the US is so serious; you can’t hold back that sort of information.

 

That all said, is it so strange that Trump has perhaps had enough of this? That he might like an actual Attorney General who actually takes charge of the case, and a Deputy AG who has some distance from Mueller and asks him to finish up the investigation which hasn’t produced anything but tax evasion charges for Manafort and 14 days in jail for Papadopoulos, who presumably pled guilty because, like Michael Flynn, he couldn’t afford to defend himself?

There are times one gets the impression the whole thing only continues because newspapers and TV channels make so much money off of painting Trump as the modern Antichrist. And while the man undoubtedly is full of flaws, that’s not what they’re all aiming for. They go for Russiagate, because it sells to have an archenemy to talk about, and they go for Stormy Daniels and Kavanaugh’s penis, because sex sells more than anything.

Along with all the anti-Trump rhetoric, there is a running story about a Blue Wave that will hand the Democrats back control over the House and perhaps the Senate. But while I think it might be good to restore some balance in Washington, if only so people must actually talk, I also think that Blue Wave thing is perhaps the biggest mistake America’s formerly left can make.

Because the Democrats, no matter how they see themselves, have no identity. Other than they’re not Trump and they hate the man. We saw that loud and clear the other day when they helped the GOP push a record military budget through the House. They’re merely a flipside of a coin. They have nothing of their own.

Yes, there’s Ocasio-Cortez and a handful others who try to define something different, but surely they must know that when you call yourself Socialist in America you’re tying an arm and a leg behind your back. Kudos for trying, but that’s not going to work. Bernie Sanders is done after allowing Hillary’s DNC to push him aside; people remember such things.

That leaves the usual suspects, Schumer, Pelosi, Feinstein, calcifying in their seats, with Hillary in the wings for a glorious return to viability in 2020. And they think that combo will make them win elections, and win them big, just because voters are so sick of Trump? Methinks perhaps they have started to believe their own stories, while neglecting those of their one-time voters.

 

But sure, let’s see what happens on Thursday, and before, with Blasey Ford and Kavanaugh’s testimonies, and with Rosenstein’s friendly chat with the President. I’m thinking there’s nothing so bizarre I would count it out, but I may have to rethink that. Maybe Robert Mueller will resign tomorrow before Rosenstein can be fired -assuming Trump would want to-, maybe Kavanaugh had sex with an entire boys’ choir twice a week, leaving him technically still a virgin.

Our fantasy is just about endless. But that’s the exact biggest problem with everything about this: there’s far too much fantasy involved, far too many allegations that remain unproven but leave traces left and right, far too many accusations that nobody is made to own up to.

One last thing: if it turns out Christine Blasey Ford can prove none of her accusations vs Kavanaugh, and he’s been telling the truth all along, what does that mean for all the women who’ve told their stories of rape and assault under the #WhyIDidntReport hashtag? How betrayed will they feel, how tricked? Or will they continue to insist that he must be guilty even if there is zero proof?

And no, it’s not Just the Democrats, it’s Washington as a whole, egged on by despairing media who see their revenues and credibility plunge and resort to cheap tricks. The Republicans with their inane plans to re-open the hunt on grizzlies are just as bad. Want to Make America Great Again? Start with protecting the grizzlies and manatees and moose and eagles. They are what makes the country rich. There won’t be anything great about a barren desert land devoid of life.

But the urgent question in Washington right at this moment is, in light of Rosenstein and Kavanaugh: how deeply can you divide a country, for political ends, before it bursts? And what will it take, what can still be done today, to pull it away from the looming abyss?

Update 5: Jonathan Swan, the Axios reporter who initially broke the news this morning that Rod Rosenstein had “verbally resigned” and subsequently triggered a drop in the Dow that erased billions of dollars in value, has issued an important “clarification” that – as fate would have it – changes the story from a major news-cycle-dominating revelation to a barely noteworthy tidbit. After sparring with Vanity Fair reporter Gabriel Sherman, who suggested that Swan “got played” by a White House insider looking to distract from the second Kavanaugh revelation, Swan has admitted that the phrasing of his initial report was a little off.

Instead of reporting that Rosenstein had “verbally resigned”, Swan said he meant to say that Rosenstein had verbally offered his resignation to Chief of Staff John Kelly. “Note for readers: I regret the way I wrote this morning’s version of the story. By saying Rosenstein had “verbally resigned” to Kelly rather than “offered his resignation,” I conveyed a certainty that this fluid situation didn’t deserve. It’s an important nuance, and I regret the wording.”

We’re sure all of those algos that sold on the headline also “regret” their error, too.

Update 4: Speaking to reporters at the United Nations, President Trump finally commented on the political event du jour, saying he’s looking forward to meeting with Deputy Attorney General Rod Rosenstein on Thursday to discuss his future and “determining what’s going on”, after Axios reported earlier that Rosenstein told Trump’s Chief of Staff John Kelly that he was resigning. “We’ll be determining what’s going on,” Trump told reporters at the United Nations on Monday. “We want to have transparency, we want to have openness and I’m looking forward to meeting with Rod at that time.” Trump didn’t answer a question about what may happen to Rosenstein. “I spoke with Rod today and we’re going to have a meeting on Thursday when I get back to the White House,” he said.

Breaking his public silence for first time since the hearings last month, Supreme Court nominee Judge Brett Kavanaugh, appeared alongside his wife, on Fox News Channel’s “The Story with Martha MacCallum” tonight to address the sexual misconduct allegations that have put his confirmation at risk of unraveling. As we detailed earlier, Brett Kavanaugh defied his accusers on Monday when he said, in a letter to Senate Judiciary Committee Sens. Chuck Grassley (R-Iowa) and Dianne Feinstein (D-Calif.), that he will “not be intimidated into withdrawing” his Supreme Court nomination and staunchly denied the accusations, calling them a “grotesque and obvious character assassination” and “a coordinated effort” to drive him out on the nomination.

Ahead of tonight’s interview, President Trump tweeted about the interview and reiterated that “this is an outstanding family who must be treated fairly!” And in tonight’s first interview since the allegation, Kavanaugh began assertively, saying: “I’m not going anywhere… “I want a fair process where I can defend my integrity, and I know I’m telling the truth,” the judge said. “I know my lifelong record and I’m not going to let false accusations drive me out of this process… I have faith in God and I have faith in the fairness of the American people.” In the interview, Kavanaugh emphatically denied Ford’s claim against him, telling McCallum that he was a virgin through high school and for “many years after.” “I did not have sexual intercourse in high school or for many years thereafter. The girls from the schools I went to and I were friends.”

(No one mentioned bong-hits, at least not yet, but how could there not have been, on top of the drinking games?) But the real gold in the story comes in this revelation: “Ramirez, who was raised a devout Catholic, in Connecticut, said that she was shaken. “I wasn’t going to touch a penis until I was married.” Really? Now that all American womanhood has been faced, shall we say, with the image of the looming universal horrifying penis, all bets on the Kavanaugh nomination are off. But the gambit does raise the possibility that it will be answered by some rough justice from the conservative side of the field. It will be interesting to see in the weeks and months ahead how many Democratic house and senate members will be revealed as would-be rapists and sluts. I can’t imagine that none of them have secrets to hide. In fact, I would take the Ramirez accusation as tantamount to a declaration of war by the Resistance. A senior Chinese official said on Tuesday it is difficult to proceed with trade talks with the United States while Washington is putting “a knife to China’s neck”, a day after both sides heaped fresh tariffs on each other’s goods. When the talks can restart would depend on the “will” of the United States, Vice Commerce Minister Wang Shouwen said at a news conference in Beijing.U.S. tariffs on $200 billion worth of Chinese goods and retaliatory taxes by Beijing on $60 billion worth of U.S. products including liquefied natural gas (LNG) kicked in on Monday, unnerving global financial markets.

“Now that the United States has adopted such a huge trade restriction measure … how can the negotiations proceed? It’s not an equal negotiation,” Wang said, stressing the United States has abandoned its mutual understanding with China. China’s top diplomat also told business people at a meeting in New York that talks could not take place against the backdrop of “threats and pressure”, the Foreign Ministry said. Certain forces in the United States have been making groundless criticisms against China about trade and security issues, which has poisoned the atmosphere for Sino-U.S. ties and is highly irresponsible, State Councillor Wang Yi was quoted as saying, without naming anyone.

US Judge Suggests He May Dismiss Stormy Daniels Lawsuit Against Trump (R.)

President Donald Trump likely had a free-speech right to make a Twitter comment disputing allegations by adult film actress Stormy Daniels, a federal judge said on Monday, indicating he was inclined to dismiss her defamation lawsuit against Trump. Daniels, whose real name is Stephanie Clifford and who has said she had a sexual encounter with Trump in 2006, sued the president for defamation in April in federal court over the tweet. The lawsuit centers on Daniels’ assertion that a man approached her in 2011 in a Las Vegas parking lot and made a veiled threat after she agreed to talk about her alleged encounter with Trump to In Touch magazine.

Soon after Daniels released a sketch of the man she said threatened her, Trump, who has denied having an affair with Daniels, disputed her account on Twitter, saying: “A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!” Daniels’ attorneys said the tweet portrayed her as a liar, but attorneys for Trump asked a federal judge in Los Angeles to dismiss the defamation lawsuit. “The question is whether the tweet by the president is protected communication or political hyperbole and non-defamatory on its face,” U.S. District Judge James Otero said at a hearing on Monday.

Otero cited certain protections from defamation Trump would have under the U.S. Constitution’s guarantee of free-speech rights. “He’s a public official, he’s president of the United States, so it doesn’t get much higher than that,” Otero said. “It’s free speech by a public official on a matter of public concern.” Otero stopped short of issuing a formal ruling on the request to dismiss the lawsuit.

UK-EU Flights To Be Grounded In Case Of No-Deal Brexit (Ind.)

Flights will be grounded if Britain crashes out of the EU next March unless an emergency aviation deal can be struck, the government has admitted. The latest batch of advice papers also warned food producers that pre-packaged products “would no longer be valid for the EU market”, without a separate EU business address. Ministers also told motorists that they would need to apply for a green card as proof of third party motor insurance cover when driving in the EU. And pet owners who want to take their dogs and cats abroad would face the significant inconvenience of having to register three months in advance.

Meanwhile, UK hauliers were warned they could be banned from the continent, because they could “no longer rely on automatic recognition by the EU of UK-issued community licences”. The Food and Drink Federation reacted with horror to the technical notices, warning they “lay bare the grisly prospect of a no-deal Brexit”. It urged Theresa May to stop “lecturing the EU” and seek to delay Brexit, by extending the Article 50 deadline, if it could not secure a withdrawal deal “imminently”. Layla Moran, a Liberal Democrat supporter of the anti-Brexit Best for Britain, said the threat to flights was “a bureaucratic nightmare and a farce”.

Labour Confirms Remain Can Be Party’s Choice In New Brexit Referendum (Ind.)

Labour is embroiled in a row over the party’s approach to a Final Say Brexit referendum, following a split between two of the shadow cabinet’s most senior figures. Sir Keir Starmer, the party’s Brexit spokesman, was forced to confirm that remaining in the EU will be a potential option in a future referendum backed by Labour after John McDonnell, the shadow chancellor, ruled the idea out. Amid a backlash Mr McDonnell rowed back on his comments, and later conceded at a meeting at the party’s conference in Liverpool that Labour could still back a new vote that would see the party stay in the EU.

It comes as Sir Keir will tell Labour conference on Tuesday that the party is set to oppose the deal Theresa May brings back from Brussels, having determined that it cannot meet his “six tests”. Another shadow cabinet minister, Barry Gardiner, also broke ranks to say that the idea the party will be able to secure a general election if Ms May’s plans fall apart was “looney tunes territory”. If the prime minister’s Brexit plans are rejected by parliament, and no election is forthcoming, then Labour’s new policy – arduously negotiated by Mr Starmer this week and to be approved on Tuesday – would see the party committed to a new Brexit referendum.

US Judge Orders Federal Protection Restored To Yellowstone Grizzlies (R.)

A federal judge on Monday ordered Endangered Species Act protections restored to grizzlies in and around Yellowstone National Park, halting plans for the first licensed trophy hunts of the bears in the region in more than 40 years. U.S. District Judge Dana Christensen in Missoula, Montana, sided with environmentalists and native American groups by overruling the U.S. Fish and Wildlife Service decision to strip the grizzlies of their status as a threatened species. The outcome caps one of the most high-profile legal battles over the Endangered Species Act in many years, rivaling previous disputes surrounding the gray wolf and northern spotted owl. The ruling came as the Trump administration is seeking to rewrite Endangered Species Act regulations that scientists say would erode wildlife protection for the benefit of commercial interests.

The Trump administration’s decision in June of last year to “de-list” the grizzly, formally proposed in 2016 during the Obama era, was based on agency findings that the bears’ numbers had rebounded enough in recent decades that federal safeguards were no longer necessary. The de-listing, welcomed by big-game hunters and cattlemen, had applied to about 700 Yellowstone-area grizzlies in Wyoming, Idaho and Montana. Environmentalists countered that treating those bears separately from other grizzly populations in Montana and elsewhere in the Lower 48 states was biologically unsound and illegal under the Endangered Species Act, and the judge agreed.

Grizzlies, which are slow to reproduce, number fewer than 2,000 bears across the Lower 48. That is far below an historic high of 100,000 before widespread shooting, poisoning and trapping reduced the bears’ population to just several hundred by 1975, when they were placed under federal protection.

France is not ready to allow the Mediterranean rescue ship Aquarius to dock and disembark dozens of migrants at the port of Marseille, France’s finance minister has said. “For the moment it’s ‘no’,” Bruno Le Maire said when asked during an interview on BFM news TV channel if Paris was ready to respond positively to a request from charities for permission to dock with 58 people onboard in the southern French port. Under European rules, ships were supposed to get docking access at the nearest port, said Le Maire, adding that Marseille was not the nearest port.

Monsanto’s Glyphosate Weedkiller Harms Honeybees, Research Finds (G.)

The world’s most used weedkiller damages the beneficial bacteria in the guts of honeybees and makes them more prone to deadly infections, new research has found. Previous studies have shown that pesticides such as neonicotinoids cause harm to bees, whose pollination is vital to about three-quarters of all food crops. Glyphosate, manufactured by Monsanto, targets an enzyme only found in plants and bacteria. However, the new study shows that glyphosate damages the microbiota that honeybees need to grow and to fight off pathogens. The findings show glyphosate, the most used agricultural chemical ever, may be contributing to the global decline in bees, along with the loss of habitat.

“We demonstrated that the abundances of dominant gut microbiota species are decreased in bees exposed to glyphosate at concentrations documented in the environment,” said Erick Motta and colleagues from University of Texas at Austin in their new paper. They found that young worker bees exposed to glyphosate exposure died more often when later exposed to a common bacterium. Other research, from China and published in July, showed that honeybee larvae grew more slowly and died more often when exposed to glyphosate. An earlier study, in 2015, showed the exposure of adult bees to the herbicide at levels found in fields “impairs the cognitive capacities needed for a successful return to the hive”.

Glyphosate Industry Fails to Stop US Funding for Global Cancer Agency (SP)

In a massive victory for independent science, it was announced Sunday that the U.S. Senate and Congress appropriations committees have deleted text from a controversial Bill, which would have cut all the U.S. funding to the International Agency for Research on Cancer (IARC), after they challenged the chemical industry by classifying the world’s most used herbicide, glyphosate, as a probable human carcinogen in 2015. BIS Warns Zombies Are Crippling Global Growth (ZH)

In the latest quarterly review from the Bank of International Settlements, the Basel-based organization that oversees the world’s central banks warned that decades of falling interest rates have led to a sharp increase in the number of “zombie” firms, rising to an all time high since the 1980s, threatening economic growth and preventing interest rates from rising. Zombie firms are defined as companies that are at least 10 years old, yet are unable to cover their debt service costs from profits, in other words the Interest Coverage Ratio (ICR) is less than 1x for at least 3 consecutive quarters. These types of companies, which first gained attention in Japan decades ago and have since gained prevalence in Europe and, increasingly, the United States.

According to a second definition, a requirement for a “zombie” is to have comparatively low expected future growth potential. Specifically, zombies are required to have a ratio of their assets’ market value to their replacement cost (Tobin’s q) that is below the median within their sector in any given year. According to authors Ryan Banerjee and Boris Hofmann, zombie firms that fall under the two definitions are very similar with respect to their current profitability, but qualitatively different in their profitability prospects, which may be a function of how central banks have “broken” the market. Graph 1 below shows that, for non-zombie firms, the median ICR is over four times earnings under both definitions. As the majority of zombie firms make losses, the median ICRs are below minus 7 under the broad measure and around minus 5 under the narrow one, so this is hardly a surprise.

‘Key Allies’ Want FBI Docs Blocked: Trump (AAP)

US President Donald Trump says “key allies” have asked him not to release classified FBI documents related to the probe into Russian influence in the 2016 presidential election, raising speculation the Australian government could be exposed. Former Australian high commissioner to the UK Alexander Downer has become a reluctant player in the controversy for his London drinks session with former Trump foreign relations aide George Papadopoulos. Papadopoulos, sentenced to 14 days’ jail for lying to the FBI, has repeatedly targeted Downer in Twitter tirades in recent days, claiming the former Australian foreign affairs minister recorded their meeting at the Kensington Wine Rooms in May, 2016, and was acting as a spy. Downer has strongly rejected this.

“Alexander Downer will go down in history as a stooge for (Hillary) Clinton who single-handedly caused irreparable damage between the USA-Australia,” Papadopoulos wrote on Twitter on Friday. “Congrats, buddy.” On Monday Trump ordered documents related to the FBI’s Russian investigation, including text messages from FBI figures Peter Strzok and Lisa Page, be declassified and released publicly. However, on Friday the president pulled back. “I met with the DOJ concerning the declassification of various UNREDACTED documents,” Trump announced on Twitter. “They agreed to release them but stated that so doing may have a perceived negative impact on the Russia probe. “Also, key Allies’ called to ask not to release.”

[..] “After reports are finally out that the British and Australian governments were actively spying and trying to sabotage the Trump campaign, those two governments called the president to ask for him not to declassify any FISA documents,” Papadopoulos wrote on Twitter. “Strange.”

White House Denies Trump Executive Order On Facebook, Google, Twitter (Ind.)

The White House sought to distance itself Saturday from reports that President Donald Trump is considering an executive order that would subject tech giants like Facebook, Google and Twitter to federal investigations for alleged political bias. For weeks, top tech companies have been on edge, fearing that the Trump administration could seek to regulate the industry in response to the president’s tweets attacking social-media sites for silencing conservatives online. Their worst suspicions seemed to come true Friday night, with the emergence of a draft executive order that called for nearly every federal agency to study how companies like Facebook police their platforms and refer instances of “bias” to the Justice Department for further study.

But three White House aides soon insisted they didn’t write the draft order, didn’t know where it came from, and generally found it to be unworkable policy anyway. One senior White House official confirmed the document had been floating around the White House but had not gone through the formal process, which is controlled by the staff secretary. Asked about the document, Lindsay Walters, the deputy White House press secretary, said of the digital-age ‘whodunit’ on Saturday: “Although the White House is concerned about the conduct of online platforms and their impact on society, this document is not the result of an official White House policymaking process.”

Christine Blasey Ford Reaches Deal to Testify at Kavanaugh Hearing (NYT)

Senators looking to confirm or refute the allegations will face a nearly impossible task. Complicating matters, Dr. Blasey has said she does not recall the specific date or location of the house where the alleged incident occurred, though she believes it was during the summer of 1982. Judge Kavanaugh’s prospects were further clouded on Sunday when The New Yorker reported on a new allegation of sexual impropriety: A woman who went to Yale with Judge Kavanaugh said that, during a drunken dormitory party their freshman year, he exposed himself to her, thrust his penis into her face and caused her to touch it without her consent.

In a statement, Judge Kavanaugh denied the allegation from the woman, Deborah Ramirez, and called it “a smear, plain and simple.” The New Yorker did not confirm with other eyewitnesses that Judge Kavanaugh was at the party. The Times had interviewed several dozen people over the past week in an attempt to corroborate her story, and could find no one with firsthand knowledge. Ms. Ramirez herself contacted former Yale classmates asking if they recalled the incident and told some of them that she could not be certain Mr. Kavanaugh was the one who exposed himself.

OPEC Predicts Massive Rise In Oil Production Over Next Five Years (G.)

World oil production will soar to new records over the next five years, as a dramatic expansion in demand from airlines offsets the arrival of electric cars, according to a report from Opec. In a forecast that will dismay environmentalists – and which questions the theory that oil company reserves will become “stranded assets” – Opec’s annual report significantly revised production estimates upwards. Most of the production increase will come from countries outside Opec, led by explosive growth from frackers in the United States, with China and India leading the increase in demand.

Opec expects global oil demand to reach nearly 112m barrels per day by 2040, driven by transportation and petrochemicals. That is up from almost 100m today and higher than last year’s projection. Coal will continue to be be burned in record amounts, despite concerns about its impact on climate change. Opec estimates that coal usage in the OECD countries will plummet by a third by 2040, but it will increase by 20% in developing countries to reach five times the volumes burned in the west. The world’s airlines will be the single fastest growing user of oil, increasing consumption by 2.2% a year on average, to 2040.

However, the largest absolute growth is expected to come from road transport. The number of vehicles on roads across the world are expected to leap from 1.1bn now to around 2.4bn in 2040. In its central scenario, Opec expects just 320m of those to be electric, a number that climbs to 720m in a scenario where battery-powered cars take off rapidly. It said that if the higher prediction for electric cars came to pass, oil demand would only slip slightly to 109m bpd rather than 111.7m bpd by 2040, the report said.

Leading Tory Eurosceptics Unveil Rival Brexit Plans (Ind.)

Leading Tory Eurosceptics are to spell out rival Brexit plans that directly contradict Theresa May’s proposals, setting the scene for intense Tory infighting just weeks before a deal is meant to be agreed with the EU. The rebel plans are likely to demand looser future relations with Brussels and are to be laid out by ex-cabinet minister David Davis and lead eurosceptic Jacob Rees-Mogg, but are also said to enjoy support inside the cabinet. In a sign of the impending hostilities, Brexit secretary Dominic Raab launched a pre-emptive attack on the approach taken by the Eurosceptics on Sunday, saying the kind of free trade deal they outline is “off the table”.

Ms May will meet her top team during the morning to discuss the fallout of last week’s summit in Salzburg where EU leaders torpedoed her “Chequers” proposals, forcing the prime minister to accuse them of disrespecting the UK. Monday’s cabinet meeting could also see a new clash between senior ministers over Britain’s future immigration policy and whether EU citizens should be afforded any kind of special status.

Labour’s New Brexit Referendum Won’t Offer Option To Remain (Ind.)

Remaining in the EU would not be on the ballot paper in a new Brexit referendum under Labour, John McDonnell has said. The shadow chancellor said Labour would “go for a people’s vote” on leaving the EU if it cannot push the government into calling a general election but any vote would only be on the terms of the deal. Rows over Brexit have dominated the start of Labour’s annual conference where more than 100 constituency parties submitted motions demanding a second referendum and thousands of people joined a march demanding a people’s vote on the final deal.

On Sunday, Jeremy Corbyn suggested Labour would shift its Brexit stance towards a vote on the final deal if party members backed it, but insisted that an election was a better way to solve the crisis. Unite boss Len McCluskey, a close ally of Mr Corbyn, went further, saying Labour could back a referendum on Theresa May’s deal or no-deal. However he said offering voters the chance to remain in the EU was “wrong”. Asked to guarantee that Labour would allow staying in the EU on the ballot paper, Mr McDonnell told the Today programme: “My view at the moment is that parliament will decide what will be on the ballot paper. “We’ll be arguing that it should be a vote on the deal itself, and then enable us to go back and do the negotiations.”

How Michael Moore Lost His Audience (Variety)

The films of Michael Moore have been faltering at the box office for several years now. This weekend, though, the lackluster performance of his latest truth-to-power opus, “Fahrenheit 11/9,” was notably dramatic, if not downright stark. The movie is a sequel, of sorts, to “Fahrenheit 9/11,” Moore’s scathing riff on the administration of George W. Bush. That movie, when it was released in 2004, made $119 million, becoming the highest-grossing documentary of all time. It was a special moment, of course. America was still grappling with the shock of 9/11, and Moore’s film became a lightning rod — a catharsis for liberals (or some of them, anyway) and a symbol, for conservatives, of everything that was wrong with liberalism. But one thing, perhaps, that everyone could agree on is that in “Fahrenheit 9/11,” Michael Moore, for good or ill, had become instrumental in defining the national dialogue.

“Fahrenheit 11/9,” his scathing riff on the administration of Donald J. Trump, will be lucky to gross one-tenth of what “Fahrenheit 9/11” did. That’s more than just a staggering comedown. It symbolizes a couple of things at once: how different the two eras are, but also how Michael Moore’s audience — there’s no other way to put it — has gradually drifted away. It symbolizes that Moore is no longer defining the dialogue. A Trump-era conservative would probably say, “It’s about time! Michael Moore has lied so much that it’s all finally caught up with him.” A Trump-era liberal would probably say, “I still agree with him, but I’ve seen enough Michael Moore movies. I know his message already.”

Panama Revokes Registration Of Last Migrant Rescue Ship In Central Med (R.)

The Panama Maritime Authority has revoked the registration of search and rescue ship Aquarius 2 in a move that means there will be no charity rescue ships off the Libyan coast in the near future unless the vessel can find a new flag to sail under. Aquarius 2, the one remaining charity rescue vessel still operating in the Central Mediterranean area, is currently at sea with 58 survivors on board. The decision by the Panama Authority (PMA) means that once the ship comes into port it will be deflagged and will not be allowed to operate again unless it can find a new flag.

SOS Mediterranee, one of the charities that operates the Aquarius, said in a statement it was reeling from news of the revocation, which it said followed pressure from the Italian government. “On Saturday … the Aquarius team was shocked to learn of an official communication from the Panamanian authorities stating that the Italian authorities had urged the PMA to take ‘immediate action’ against the Aquarius,” it said. Italy’s Interior Minister Matteo Salvini said the Italian government had applied no pressure on Panama.

America’s Era Of Climate Mass Migration Is Here (G.)

The population shift gathering pace is so sprawling that it may rival anything in US history. “Including all climate impacts it isn’t too far-fetched to imagine something twice as large as the Dustbowl,” said Jesse Keenan, a climate adaptation expert at Harvard University, referencing the 1930s upheaval in which 2.5 million people moved from the dusty, drought-ridden plains to California. This enormous migration will probably take place over a longer period than the Dustbowl but its implications are both profound and opaque. It will plunge the US into an utterly alien reality. “It is very difficult to model human behaviour under such extreme and historically unprecedented circumstances,” Keenan admits.

The closest analogue could be the Great Migration – a period spanning a large chunk of the 20th century when about 6 million black people departed the Jim Crow south for cities in the north, midwest and west. By the end of this century, sea level rise alone could displace 13 million people, according to one study, including 6 million in Florida. States including Louisiana, California, New York and New Jersey will also have to grapple with hordes of residents seeking dry ground. “There’s not a state unaffected by this,” said demographer Mat Hauer, lead author of the research, which is predicated on a severe 6ft sea level increase.

There are established migration preferences for some places – south Florida to Georgia, New York to Colorado – but in many cases people would uproot to the closest inland city, if they have the means. “The Great Migration was out of the south into the industrialized north, whereas this is from every coastal place in the US to every other place in the US,” said Hauer. “Not everyone can afford to move, so we could end up with trapped populations that would be in a downward spiral. I have a hard time imagining what that future would be like.”

Air Pollution Rots Our Brains. Is That Why We Don’t Do Anything About It? (G.)

Researchers from Beijing University and Yale School of Health published research last month showing that people who live in major cities – which is, today, most of us – are not only suffering from increases in respiratory illnesses and other chronic conditions due to air pollution, but are losing our cognitive functions. The study showed that high pollution levels lead to significant drops in test scores in language and arithmetic, with the impact on some participants equivalent to losing several years of education. Other studies have shown that high air pollution is linked to premature birth, low birth weight, mental illness in children and dementia in the elderly.

We’re only just beginning to understand how the air we breathe affects not just our physical environment, but our mental capacity as well. And the air we breathe is changing in the long term, as well as the short. Rising carbon dioxide levels – the main driver of climate change – aren’t just a hazard to the earth and other living creatures, they’re also affecting our thinking. At higher levels, CO2 clouds the mind: it makes us slower and less likely to develop new ideas, it degrades our ability to take in new information, change our minds, or formulate complex thoughts.

Trump To Investigate Google, Facebook Under New Executive Order (ZH)

According to a an early draft of an Executive Order (EO), the White House will instruct federal law enforcement and antitrust agencies to launch investigations into the business practices of Facebook, Google and other social media companies, according to Bloomberg which says it has seen the draft. While not specifically calling out companies by name, the document orders US antitrust officials to “thoroughly investigate whether any online platform has acted in violation of the antitrust laws,” while instructing other agencies to return recommendations within a month of Trump signing the EO which could potentially “protect competition among online platforms and address online platform bias.”

“The document doesn’t name any specific companies. If signed, the order would represent a significant escalation of Trump’s antipathy toward Google, Facebook, Twitter and other social media companies, whom he has publicly accused of silencing conservative voices and news sources online. … The draft order directs that any actions federal agencies take should be “consistent with other laws” — an apparent nod to concerns that it could threaten the traditional independence of U.S. law enforcement or conflict with the First Amendment, which protects political views from government regulation.” -Bloomberg

[..] According to Pew Research Center, 72% of Americans, and in particular 85% of Republicans and right-leaning independents think social media companies purposefully censor political viewpoints which run counter to their internal culture. “The belief that technology companies are politically biased and/or engaged in suppression of political speech is especially widespread among Republicans. Fully 85% of Republicans and Republican-leaning independents think it likely that social media sites intentionally censor political viewpoints, with 54% saying this is very likely. And a majority of Republicans (64%) think major technology companies as a whole support the views of liberals over conservatives.” – Pew

British Prime Minister Theresa May’s aides have begun contingency planning for a snap election in November to save both Brexit and her job, the Sunday Times reported. The newspaper said that two senior members of May’s Downing Street political team began “wargaming” an autumn vote to win public backing for a new plan, after her Brexit proposals were criticised at a summit in Salzburg last week.

Labour To Trigger Early Election If May Defeated In Parliament (Ind.)

Labour will launch a plan to force an election by seeking a motion of no confidence in the government within days if Theresa May’s Brexit deal is defeated in parliament, The Independent has learnt. Jeremy Corbyn and his top team will launch an attempt to force the Conservative administration to go to the people at what they believe will be a moment of maximum weakness for the prime minister. Multiple sources confirmed party chiefs have game-planned their approach if Ms May’s beleaguered proposals are vetoed in a crucial commons vote or if she fails to get a deal in Europe, which looks increasingly likely after EU leaders torpedoed them earlier this week.

A motion of no confidence would need some support from Conservative MPs to pass, but either way would act to severely destabilise the prime minister as internal pressure for her to quit peaked. The moment could also prove critical for Labour’s own approach to Brexit, with the party having stated its preference for an election while signalling that if one is not possible it could back a new referendum. It comes as Labour starts its 2018 conference in Liverpool, with Brexit and the party’s approach to holding a fresh public vote on the outcome of negotiations set to dominate the agenda.

Crashing Out Of EU May Hasten Breakup Of UK – Ministers (G.)

Theresa May is being warned by cabinet colleagues that a shift towards a harder Brexit will hasten the break-up of the UK, amid a renewed attempt by Brexiters to secure a clean split from the European Union. With senior Tories warning that the prime minister now risks a diplomatic calamity on the scale of the Suez crisis, following her disastrous Salzburg summit, she is facing a renewed campaign among ministers and influential backbenchers to ditch her current plans and back a looser free trade deal with the EU. However, some cabinet ministers are concerned such a shift will effectively place a border between Northern Ireland and Britain and put it “in the departure lounge from the UK”.

Cabinet sources are also warning that such a move would reignite the debate about Scotland’s place in the UK and further unravel the union. “Nobody voted Brexit to break up the UK,” one minister said. Another said: “Those advocating [the free trade deal] approach need to face up to the consequences for the union.” Some Tory aides are said to be so worried about the lack of support for May’s current Brexit plans that they fear another snap election will be needed before the end of the year. Downing Street sources categorically denied that such an option was being considered in No 10.

Last night, May again attempted to calm the warring factions in her party, calling for “cool heads”. “It is time to hold our nerve,” she said. “I have said many times that these negotiations would be tough, and they were always bound to be toughest in the final straight.” She also accused Labour, Lib Dem and SNP figures of “actively undermining the UK’s negotiating position” in their talks with the EU.

Jeremy Corbyn has said he will back giving the British people a final say on Brexit in a new referendum if party members vote for it at Labour’s conference this week. The Labour leader said that while he had not called for it up to now he had been elected to “empower” members and would not “walk away from it” if they demanded a new vote. Mr Corbyn also said he would join forces with rebel Tories to vote down Theresa May’s Brexit plans in parliament if they did not meet Labour’s tests, with The Independent reporting on Saturday that the party would then maximise pressure on the prime minister by seeking a motion of no confidence in the government if her proposals fell.

The Labour leader’s new comments on a People’s Vote Brexit referendum come as a new YouGov poll showed his party’s members overwhelmingly back one, while more than 100 motions relating to a new vote have been proposed for the conference in Liverpool. He said: “What comes out of conference I will adhere to. But I’m not calling for a second referendum. I hope we will agree that the best way of resolving this is a general election. “But I was elected to empower the members of the party.

Kavanaugh Accuser Has No-One Left To Corroborate Her Story (ZH)

A woman believed to have been one of five people at a party some 35 years ago where Christine Blasey Ford claims she was sexually assaulted by Brett Kavanaugh has become the fourth person to deny any recollection of the event. In a Saturday night email to the Senate Judiciary Committee also received by several news outlets, Leland Ingham Keyser – a “longtime friend” of Blasey Ford’s said through her attorney: “Simply put, Ms. Keyser does not know Mr. Kavanaugh and she has no recollection of ever being at a party or gathering where he was present, with, or without, Dr. Ford,” said Keyser’s attorney Howard Walsh, who has been “engaged in the limited capacity” of corresponding with the committee on behalf of Keyser, according to Politico.

Kavanaugh and Mark Judge – the other teenager allegedly in the room during the alleged sexual assault – have both stated that they have no recollection of the incident, while a third man who Ford claims was at the party – Patrick J. Smyth, also denied any recollection of the event, telling the Judiciary Committee last week in a statement: “I understand that I have been identified by Dr. Christine Blasey Ford as the person she remembers as ‘PJ’ who supposedly was present at the party she described in her statements to the Washington Post,” Smyth wrote in his statement. “I am issuing this statement today to make it clear to all involved that I have no knowledge of the party in question; nor do I have any knowledge of the allegations of improper conduct she has leveled against Brett Kavanaugh.”

[..] On Saturday night, a tentative deal was reached for Ford to testify publicly on Thursday, according to the New York Times. “After a brief call late on Saturday, the woman’s lawyers and aides to Senator Charles E. Grassley of Iowa, the Republican chairman of the Judiciary Committee, planned to talk again Sunday morning to continue the halting negotiations over the conditions of the testimony, according to three people familiar with the call. Aides to Senator Dianne Feinstein of California, the committee’s top Democrat, were also involved.” -NY Times The Times notes, however, that Leland Keyser’s statement “seemed to eliminate any chance of corroboration of Dr. Blasey’s account by anyone who attended the high school party where she says she was assaulted.”

The US secretary of state, Mike Pompeo, has hinted that Rod Rosenstein could be in jeopardy, after reports on Friday said the deputy attorney general discussed wearing a wire to record conversations with Donald Trump and the possibility of invoking the 25th amendment to remove the president. In excerpts of an interview with Fox News Sunday, Pompeo said: “If you can’t be on the team, if you’re not supporting this mission, then maybe you just ought to find something else to do.” Asked by the host Chris Wallace if Rosenstein’s reported behaviour would constitute “being on the team”, Pompeo said: “Not remotely.”

Rosenstein oversees the special counsel Robert Mueller, who is investigating Russian election interference, links between Trump aides and Moscow and potential obstruction of justice by the president. The deputy attorney general’s remarks were reported by the New York Times and confirmed by other outlets. Speculation that Trump might fire Rosenstein, as a way to neutralise Mueller, increased to fever pitch. Such a move from the president, which would carry strong echoes of the Watergate affair which brought down Richard Nixon, would likely push the US to the brink of a constitutional crisis.

[..] Pompeo’s remarks to Fox were released after Trump told a rally in Springfield, Missouri on Friday night he would act to rid the Department of Justice and the FBI of “a lingering stench” of disloyalty. Also on Friday night, the Fox News hosts Laura Ingraham, Jeanine Pirro and Gregg Jarrett advocated firing Rosenstein. However Sean Hannity, who has perhaps even more influence with the president than Ingraham or Pirro, said Trump should not do that. In what he called “a message for the president”, Hannity said: “Under zero circumstances should the president fire anybody … I have multiple sources confirming this … it is all a set-up.”

The New York Times as Judge and Jury (Lauria)

In a massive Times‘ article published on Thursday, entitled, “‘A Plot to Subvert an Election: Unravelling the Russia Story So Far,” it seems that reporters Scott Shane and Mark Mazzetti have succumbed to the same thinking that doubled down on Iraq. They claim to have a “mountain of evidence” but what they offer would be invisible on the Great Plains. With the mid-terms looming and Special Counsel Robert Mueller unable to so far come up with any proof of collusion between Russia and the Trump campaign to steal the 2016 election—the central Russia-gate charge—the Times does it for him, regurgitating a Russia-gate Round-Up of every unsubstantiated allegation that has been made—deceptively presented as though it’s all been proven.

This is a reaffirmation of the faith, a recitation of what the Russia-gate faithful want to believe is true. But mere repetition will not make it so. The Times’ unsteady conviction is summed up in this paragraph, which the paper itself then contradicts only a few paragraphs later: “What we now know with certainty: The Russians carried out a landmark intervention that will be examined for decades to come. Acting on the personal animus of Mr. Putin, public and private instruments of Russian power moved with daring and skill to harness the currents of American politics. Well-connected Russians worked aggressively to recruit or influence people inside the Trump campaign.” But this schizoid approach leads to the admission that “no public evidence has emerged showing that [Trump’s] campaign conspired with Russia.”

The Times also adds: “There is a plausible case that Mr. Putin succeeded in delivering the presidency to his admirer, Mr. Trump, though it cannot be proved or disproved.” This is an extraordinary statement. If it cannot be “proved or disproved” what is the point of this entire exercise: of the Mueller probe, the House and Senate investigations and even of this very New York Times article? Attempting to prove this constructed story without proof is the very point of this piece.

Iran Summons UK, Dutch, Danish Envoys Over Attack On Military Parade (G.)

Iran has summoned envoys from the United Kingdom, the Netherlands and Denmark over Saturday’s deadly shooting of 29 people at a military parade in the south of the country, state media has reported. The British charge d’affaires, along with the Dutch and Danish ambassadors, were “informed of Iran’s strong protests over their respective countries’ hosting of some members of the terrorist group” which carried out the attack, the official news agency Irna said. Gunmen sprayed a crowd with bullets in the south-western city of Ahvaz, at a military parade in the in oil-rich Khuzestan province. Members of Iran’s elite Revolutionary Guards and soldiers from the country’s army, as well as civilians, including children, were among the victims.

Islamic State and an Arab nationalist separatist group, called the Patriotic Arab Democratic Movement in Ahwaz, both claimed responsibility for the attack. Islamic State said via Amaq, the news outlet linked to the group, that “Islamic State fighters attacked a gathering of Iranian forces” in Ahvaz. Isis wrongly suggested the Iranian president was speaking at the parade. Hassan Rouhani was speaking at a parade in the capital, Tehran, instead. Iran called on Denmark and the Netherlands to extradite the attack’s “perpetrators and their accomplices” to stand trial, Irna said, citing foreign ministry spokesman Bahram Qasemi. “It is not acceptable that the European Union does not blacklist members of these terrorist groups as long as they do not perpetrate a crime on … European soil,” Qasemi was quoted as saying.

Greek Journalists Detained After Reporting Mishandling Of Migrant Funds (K.)

The publisher and editor in chief of a Greek newspaper have been detained over an article that alleges mishandling of European Union funds meant to improve conditions in migrant hotspots across the country. The journalists were detained following a complaint by Defense Minister Panos Kammenos, whose ministry is handling the EU funding. The article published Friday alleged some of the recipients of EU funding were businessmen connected to Kammenos. Panayiotis Lampsias, editor-in-chief of daily “Fileleftheros” (Liberal) told AP that “we are at the Exarchia police precinct, where we will spend the night and probably be sent to a prosecutor” on Sunday.

Opposition parties have condemned the detention. Conservative New Democracy party accused the defense minister of “thuggery” and said the real issue was the mishandling of funds. “Whether he wants it or not, [Kammenos] will be held accountable for the national shame that is Moria,” ND said in a statement. “The same goes for his ostensibly left-wing sensitive fellow ministers who on a daily basis humiliate human existence and tarnish Greece’s image across the world,” it said.

Mysterious Great White Shark Lair Discovered In Pacific Ocean (SFC)

A scientific mission into the secret ocean lair of California’s great white sharks has provided tantalizing clues into a vexing mystery — why the fearsome predators spend winter and spring in what has long appeared to be an empty void in the deep sea. A boatload of researchers from five scientific institutions visited the middle-of-nowhere spot between Baja California and Hawaii this past spring on a quest to learn more about what draws the big sharks to what has become known as the White Shark Cafe, almost as if they were pulled by some astrological stimulus.

The sharks’ annual pilgrimage to the mid-Pacific region from the coasts of California and Mexico has baffled scientists for years, not just because it is so far away — it takes a month for the sharks to get there — but because it seemed, on the surface, to be lacking the kind of prey or habitat that the toothy carnivores prefer. But the researchers made a remarkable discovery. Instead of blank, barren sea, the expedition, led by scientists with Stanford University and the Monterey Bay Aquarium, found a vast community of tiny light-sensitive creatures so tantalizing that the sharks cross the sea en masse to reach them. The primary lure, scientists believe, is an extraordinary abundance of squid and small fish that migrate up and down in a little understood deep-water portion of ocean known as the “mid-water,” a region skirting the edge of complete darkness that could provide an immeasurably valuable trove of information about the ocean ecosystem and climate change.

What’s clear so far is that, like the hidden community of specialized wildlife in the Sahara, the shark cafe is a swirling mass of tiny phytoplankton, fish, squid and jellies. They move up and down in a soupy layer deep under water, a kind of twilight zone just below where sunlight stops penetrating the ocean depths. “It’s the largest migration of animals on Earth — a vertical migration that’s timed with the light cycle,” Jorgensen said. “During the day they go just below where there is light and at night they come up nearer the surface to warmer, more productive waters under the cover of darkness.” It’s a surreal deep water world populated by bioluminescent lantern fish and other species that have evolved amazing adaptations to darkness, Jorgensen said.

The New York Times now helps Trump, or do they think this hurts him?

Rosenstein Proposed Secretly Recording Trump, Invoking 25th Amendment (ZH)

[..] the NYT recounted on Friday an aborted mutiny attempt organized by Rosenstein, who allegedly tried to organize members of Trump’s cabinet to invoke the 25th amendment to oust Trump from office. In an attempt to persuade the clearly reluctant members of Trump’s cabinet, Rosenstein suggested that he or other officials should secretly tape Trump “to expose the chaos” he said was engulfing the West Wing. According to NYT, the sources were either briefed on Rosenstein’s plans, or learned about it from the files of former FBI Deputy Director Andrew McCabe, who was fired after being disgraced by an inspector general investigation. ABC News, which also reported the story, cited sources familiar with McCabe’s files. A grand jury is also weighing whether to press charges against McCabe for allegedly misleading the inspector general.

“Mr. Rosenstein made the remarks about secretly recording Mr. Trump and about the 25th Amendment in meetings and conversations with other Justice Department and F.B.I. officials. Several people described the episodes, insisting on anonymity to discuss internal deliberations. The people were briefed either on the events themselves or on memos written by F.B.I. officials, including Andrew G. McCabe, then the acting bureau director, that documented Mr. Rosenstein’s actions and comments. None of Mr. Rosenstein’s proposals apparently came to fruition. It is not clear how determined he was about seeing them through, though he did tell Mr. McCabe that he might be able to persuade Attorney General Jeff Sessions and John F. Kelly, then the secretary of homeland security and now the White House chief of staff, to mount an effort to invoke the 25th Amendment.”

[..] Mr. Rosenstein disputed this account. “The New York Times’s story is inaccurate and factually incorrect,” he said in a statement. “I will not further comment on a story based on anonymous sources who are obviously biased against the department and are advancing their own personal agenda. But let me be clear about this: Based on my personal dealings with the president, there is no basis to invoke the 25th Amendment.”

NY Times, McCabe Give Trump Perfect Cover To Fire Rosenstein, Sessions (Hill)

It has been a year of ironies: President Trump’s personal lawyer, Michael Cohen, once said he would take a bullet for Trump and now seeks to destroy him (and to do so pro bono). Sen. Ted Cruz (R-Texas) once denounced Trump for suggesting Cruz’s father was a presidential assassin but now politically relies on and praises the man who called him “Lying Ted.” The greatest irony of all, however, could be how the newspaper that Trump loves to call “the failing New York Times” succeeded in delivering to him what he has long wanted: a clean shot at firing Attorney General Jeff Sessions and Deputy Attorney General Rod Rosenstein, and then installing a new AG to oversee special counsel Robert Mueller.

To make this more bizarre, Trump could rely for all this on the man he publicly called on to be fired and possibly prosecuted — former FBI Acting Director Andrew McCabe. The Times dropped a bombshell story late Friday that Rosenstein discussed secretly recording Trump and seeking cabinet support to force him out of office as being incapacitated under the 25h Amendment. Rosenstein denies the story as “inaccurate and factually incorrect,” insisting “there is no basis to invoke the 25th Amendment.” However, McCabe reportedly wrote memos stating that Rosenstein did discuss the possibility of taping and entrapping the president. Trump has previously referred to McCabe’s memos as “fake.”

At least one source has said the comments about secret taping were made in jest. Of course, joking about secretly taping your boss or forcing him from office is not a huge improvement, particularly when you are technically controlling a special counsel’s investigation of the president. Even in jest, it fulfills Trump’s long narrative of a Justice Department set against him from the outset. So how could the Times clear the way for Trump to clean house at Justice and end up with Mueller directly controlled by an attorney general of his choosing? Simple.

[..] late Friday, Grassley tweeted: “Five times now we hv granted extension for Dr Ford to decide if she wants to proceed w her desire stated one wk ago that she wants to tell senate her story Dr Ford if u changed ur mind say so so we can move on I want to hear ur testimony. Come to us or we to u.” Minutes later, he added: “Judge Kavanaugh I just granted another extension to Dr Ford to decide if she wants to proceed w the statement she made last week to testify to the senate She shld decide so we can move on I want to hear her. I hope u understand. It’s not my normal approach to b indecisive.”

Grassley followed with a candid lament that he was being outmaneuvered by Democrats: “With all the extensions we give Dr Ford to decide if she still wants to testify to the Senate I feel like I’m playing 2nd trombone in the judiciary orchestra and [Senate Minority Leader Chuck] Schumer is the conductor.” Grassley and other Republicans want Ford to appear on Wednesday, though Ford has requested a Thursday appearance. They accepted some of Ford’s requests after holding a conference call on Friday morning such as allowing one camera in the room, making sure Kavanaugh and Ford aren’t in the same hearing room at the same time and giving Ford breaks during testimony as well as security from the U.S. Capitol Police.

This might come as a shock to readers, but the time is not far off when the remaining not-insane cohort of adult Americans gets good and goddamn sick of political sex bombing. Especially given this case of shuck-and-jive. Consider that the same CNN this week produced an entire segment about the shape and size of the President’s generative organ (as reported by an expert in these matters, the porn star and prostitute known as Stormy Daniels). It must be a subject of extraordinary interest to CNN’s Anderson Cooper. On the other flank of the news this week is the much more perilous showdown between the Department of Justice (and the FBI), and Mr. Trump, the cis-hetero-white Golem who happens to be president.

He has ordered these agencies to produce a set of un-redacted documents pertaining to the long-running Russia investigation, set into motion by personnel at these very places. It’s his prerogative under the constitution to do that. In turn, these agencies are being egged on by possibly culpable characters in this melodrama, such as former CIA Director John Brennan and Congressman Adam Schiff (D-Cal), to stonewall the Golem. If I were president — and I may get there yet — I’d send federal marshals into Rod Rosenstein’s office to seize these documents before they are mysteriously “lost.” A tremendous tension hangs over this transaction. Imagine the awful possibility that Mr. Trump may have to declare some kind of martial law to roust out these seditious rascals and clean up their departments. There’s your Fourth Turning horror show with whipped cream and a cherry on top.

Theresa May Demands European Leaders Show UK Respect (Ind.)

Theresa May has demanded EU leaders show Britain respect, branding their public rejection of her Brexit proposals “not acceptable”. In a statement at Downing Street, the prime minister hit out at the way European Council President Donald Tusk discarded her plans without giving a detailed explanation or offering alternatives. Ms May said neither of the options previously offered by the EU were acceptable, stated that talks are now at an “impasse” and underlined her willingness to walk away if needs be – finishing with the words “we stand ready”. But the prime minister also made a new pledge to guarantee the rights of EU citizens living and working in the UK, even in the event of a no-deal Brexit.

Her intervention won approval from cabinet Brexiteers and to an extent from MPs on Conservative benches, steadying a volatile political situation which hours earlier had seen critics predicting the collapse of her strategy. Mr Tusk had surprised British officials by making an unexpectedly strong statement at the end of a summit in Salzburg this week, saying Ms May’s proposals for Brexit “will not work” and following it up with a social media post mocking her negotiating strategy. With pressure mounting, Ms May acknowledged from inside No.10 that Mr Tusk said the UK proposals would undermine the single market, but added: “He didn’t explain how in any detail or make any counter-proposal. So we are at an impasse.”

She said: “Throughout this process, I have treated the EU with nothing but respect. The UK expects the same. A good relationship at the end of this process depends on it. “At this late stage in the negotiations, it is not acceptable to simply reject the other side’s proposals without a detailed explanation and counter proposals. “So we now need to hear from the EU what the real issues are and what their alternative is so that we can discuss them. Until we do, we cannot make progress.”

Legal Action To Revoke Article 50 Referred To European Court Of Justice (G.)

A legal action to establish whether the UK can unilaterally stop Brexit has been referred to the European court of justice by the court of session in Edinburgh. The case was brought by a cross-party group of six Scottish MPs, MEPs and MSPs, who want the ECJ to offer a definitive ruling on whether the UK can halt the article 50 process without needing the approval of all other 27 EU member states. Rejecting the argument put forward by lawyers for the UK government, that ministers have repeatedly made it clear they have no intention of stopping the Brexit process, even if there were no deal with the EU, Scotland’s most senior judge, Lord Carloway, said: “It seems neither academic nor premature to ask whether it is legally competent to revoke the notification and thus to remain in the EU.”

Carloway, one of three judges to consider the case on appeal after it was initially rejected in June as “academic and hypothetical”, noted that the Commons would be required to vote on whether to ratify any Brexit deal before 29 March 2019, “a date which is looming up”, and that a judgment from the ECJ would “have the effect of clarifying the options open to MPs in the lead-up to what is now an inevitable vote”. Lord Menzies said: “There will have to be a vote, and it appears to me to be legitimate for those who are involved in that vote to know, by means of a judicial ruling, the proper legal meaning of article 50, and in particular whether a member state which has given notification of its intention to withdraw from the EU may revoke that notification of intention unilaterally before the expiry of two years after the notification.”

UK PM May Facing Ministerial Resignations Over Brexit Plan (R.)

Some of British Prime Minister Theresa May’s ministers will demand a “Plan B” on her Brexit proposal next week and could quit if she does not change course, the Telegraph newspaper reported late on Friday, citing unnamed sources. Ministers will demand an alternative plan to her “Chequers” proposal at a Cabinet meeting on Monday, the Telegraph said. That plan had already been savaged by European Union leaders in Salzburg earlier in the week, prompting May to defiantly challenge leaders of the bloc to come up with its own plans. Pro-Brexit members of May’s party on Friday had welcomed her defiant tone, but her Chequers proposal has many domestic critics, too.

The Telegraph said there was “speculation” that work and pensions minister Esther McVey might walk out of Monday’s meeting if no new proposal was presented, while international development minister Penny Mordaunt was also tipped as a possible resignation candidate, though the newspaper said friends denied she would resign. Earlier on Friday, Mordaunt said that the EU’s attitude was increasing support within Britain for an exit from the bloc, even if it meant leaving without a deal. .

Russia, Turkey Agree Borders Of Syria Demilitarised Zone (AFP)

Russia and Turkey have agreed on borders of a demilitarised zone in northern Syria, Russia’s top diplomat said Friday, part of a deal that could check an assault on the last rebel enclave in Idlib. “Just yesterday or the day before, the militaries of Russia and Turkey agreed the concrete frontiers of the demilitarised zone,” Russian Foreign Minister Sergei Lavrov said after talks with his Bosnian counterpart Igor Crnadak. Moscow says the demilitarised zone would help stop attacks from Idlib on Syrian army positions and Russia’s military bases in the region. Russian President Vladimir Putin and Turkish counterpart Recep Tayyip Erdogan agreed the establishment of the 15 to 20 kilometre (9.3-12 miles) buffer zone on Monday after talks that lasted more than four hours.

Security in the zone, which includes parts of Idlib and neighbouring provinces including the city of Aleppo, will be overseen by Turkish contingents and Russian military police. The agreement will prevent military action against the city of Idlib, Russia’s defence minister said. “It’s an intermediate step… but a necessary step,” Lavrov said of the zone. “By mid-October, all (fighters of the Al-Nusra Front) must leave this demilitarised zone, and all heavy military equipment must be pulled out of there,” he said.

Google Suppresses Memo Revealing Plans To Track Search Users In China (IC)

Google bosses have forced employees to delete a confidential memo circulating inside the company that revealed explosive details about a plan to launch a censored search engine in China, The Intercept has learned. The memo, authored by a Google engineer who was asked to work on the project, disclosed that the search system, codenamed Dragonfly, would require users to log in to perform searches, track their location — and share the resulting history with a Chinese partner who would have “unilateral access” to the data. The memo was shared earlier this month among a group of Google employees who have been organizing internal protests over the censored search system, which has been designed to remove content that China’s authoritarian Communist Party regime views as sensitive, such as information about democracy, human rights, and peaceful protest.

According to three sources familiar with the incident, Google leadership discovered the memo and were furious that secret details about the China censorship were being passed between employees who were not supposed to have any knowledge about it. Subsequently, Google human resources personnel emailed employees who were believed to have accessed or saved copies of the memo and ordered them to immediately delete it from their computers. Emails demanding deletion of the memo contained “pixel trackers” that notified human resource managers when their messages had been read, recipients determined.

French Court Orders Psychiatric Assessment of Marine Le Pen (Sp.)

The request is connected with a series of images she posted on Twitter showing Daesh* executions. France’s National Rally party leader Marine Le Pen took to Twitter to express her anger with the court order. “I thought I had been through it all: well, no! For denouncing the horrors of Daesh (Isis) with tweets, the “justice system” has referred me for a psychiatric assessment. How far will they go?!” she said. “This regime is really starting to be frightening,” Le Pen added. Le Pen noted that, contrary to French media reports, the procedure was not customary. According to a decision made on September 11, which Le Pen posted on Twitter, the purpose of the psychiatric assessment was to answer the question: “Can she [Le Pen] understand the statements and answer the questions.”

In the list of questions given to the experts, there were eight points, among which were: “whether she acted under the influence of forces or circumstances of force majeure” as well as “is she in a dangerous state from the standpoint of psychiatry or forensic science, and what is the forecast,” among others. The National Assembly (lower house of parliament) of France in November 2017, at the request of the Nanteré Prosecutor’s Office, deprived Le Pen of parliamentary immunity in connection with the publication on Twitter. If the French court finds her guilty, the leader of the party may face up to three years in prison and a fine of 75,000 euros.

Russia’s Secret Plan To Help Julian Assange Escape From UK (G.)

Russian diplomats held secret talks in London last year with people close to Julian Assange to assess whether they could help him flee the UK, the Guardian has learned. A tentative plan was devised that would have seen the WikiLeaks founder smuggled out of Ecuador’s London embassy in a diplomatic vehicle and transported to another country. One ultimate destination, multiple sources have said, was Russia, where Assange would not be at risk of extradition to the US. The plan was abandoned after it was deemed too risky. The operation to extract Assange was provisionally scheduled for Christmas Eve in 2017, one source claimed, and was linked to an unsuccessful attempt by Ecuador to give Assange formal diplomatic status.

The involvement of Russian officials in hatching what was described as a “basic” plan raises new questions about Assange’s ties to the Kremlin. The WikiLeaks editor is a key figure in the ongoing US criminal investigation into Russia’s attempts to sway the outcome of the 2016 presidential election. Robert Mueller, the special counsel conducting the investigation, filed criminal charges in July against a dozen Russian GRU military intelligence officers who allegedly hacked Democratic party servers during the presidential campaign. The indictment claims the hackers sent emails that embarrassed Hillary Clinton to WikiLeaks. The circumstances of the handover are still under investigation. According to Mueller, WikiLeaks published “over 50,000 documents” stolen by Russian spies. The first tranche arrived on 14 July 2016 as an encrypted attachment. Assange has denied receiving the stolen emails from Russia.

Despite widespread speculation a few months ago that WikiLeaks founder Julian Assange may be kicked out of the Ecuadorian embassy by the country’s new leadership, his asylum seems to be safe for now, his lawyer told RT. In July, there were numerous reports that Ecuador’s president, Lenin Moreno, may revoke the political asylum given to Assange by his predecessor, Rafael Correa, as part of an effort to establish closer ties with the US. The threat never materialized, but his long-time lawyer said “anything could happen at any time.” “Ecuador has made it clear in the past few months – after this wide-spread speculation that he would be forced to leave – that they will respect the asylum,” she said.

Assange remains cut off from all communications and kept in what is effectively solitary confinement with no access to outdoor areas. His health is deteriorating, and the UK authorities have made sure that he won’t get treatment without leaving the embassy, she said. Assange was granted asylum in August 2012, skipping bail in the UK justice system. At that time, he was fighting extradition to Sweden, where he faced prosecution over a now-closed case over alleged sex offenses. He said he had to seek Ecuador’s protection because if forced to go to Sweden, he could be extradited to the US and face serious charges over his actions as WikiLeaks founder.

Ecuador Reportedly Mulled Sending Assange As A Diplomat To Russia (RT)

London refused to grant WikiLeaks founder Julian Assange diplomatic immunity so he could escape the confinement of the Ecuadorian embassy in the UK and relocate to Russia, Reuters reports, citing government communications. The persona of Julian Assange has become a thorn in Ecuador’s president Lenin Moreno’s side and, ever since assuming office in May of last year, Moreno has made every effort to make sure the Australian’s stay at Ecuador’s embassy in London comes to an end as soon as possible. To shift the responsibility for Assange’s protection against US persecution, Ecuador allegedly mulled offering the WikiLeaks founder a diplomatic post in Russia, which the country hoped would enable him –protected by diplomatic immunity– to finally leave the embassy after six years of arbitrary detention.

London, however, refused to honor Moreno’s move to authorize “special designation” for 47-year-old to carry out diplomatic functions in Moscow, and declined to grant the whistleblower a free passage out of the country, Reuters reports, citing a letter by Ecuador’s foreign ministry to opposition legislator Paola Vintimilla. According to the letter, Quito abandoned its idea to relocate the whistleblower to Moscow after the UK Foreign Office refused to recognize Assange’s special status, or any privileges and immunities awarded under the Vienna Convention on Diplomatic Relations. The “special designation” status awarded by the Ecuadorian president would allow Assange to hold diplomatic posts abroad even if the whistleblower is not career diplomat. However, under English law, the 47 year-old can only enjoy diplomatic privileges, such as immunity, only if his credentials are accepted by the Foreign Office.

[..] Citing at least four, traditionally anonymous, sources, the Guardian wrote that Moscow was plotting to smuggle Assange out of London on Christmas eve last year, but dropped the plan because it was “deemed too risky.” The paper, claimed that Ecuador’s former London consul, Fidel Narvaez, was in talks with Russian diplomats and in constant contact with a ‘Russian businessman’ who coordinated the proposed operation with the Kremlin. It took the newspaper a mere five paragraphs of its 1,000-word report to bring up “questions about Assange’s ties to the Kremlin” in the context of the notorious Mueller probe and alleged ‘Russian hacking’ of the US elections.

Two thirds of Americans get at least some of their news on social media. Google and Facebook receive well over 70% of US digital advertising revenues. The average daily time spent on social media is 2 hours. Just a few factoids that have at least one thing in common: nothing like them was around 10 years ago, let alone 20. And they depict a change, or set of changes, in our world that will take a long time yet to understand and absorb. Some things just move too fast for us to keep track of, let alone process.

Those of us who were alive before the meteoric rise of the hardware and software of ‘social’ media may be able to relate a little more and better than those who were not, but even that is not a given. There are plenty people over 20, over 30, that make one think: what did you do before you had that magic machine? When you walk down the street talking to some friend, or looking at what your friends wrote on Facebook, do you ever think about what you did in such situations before the machine came into your life?

 


From 10% to 75% in 10 years

 

We’re not going to know what the hardware and software of ‘social’ media will have done to our lives, individually and socially, for a very long time. But in the meantime, their influence will continue to shape our lives. They change our societies, the way we interact with each other, in very profound ways; we just don’t know how profound, or how, period. There can be little question that they change us as individuals too; they change how we communicate, and in such a way that there is no way they don’t also change our very brain structures in the process.

Someone who walks down a street talking to someone else 10, 100, 1000 miles away, or sees messages from such a person come in in virtual real time, experiences things that were not available ever in human history. Our brains must adapt to these changes, or we will be left behind. And while for the over-20, over-30 crowd this takes actual adaptation, for those younger than that it comes quasi pre-cooked: they’ve never known anything else. Still, their brains were formed in completely different times too. Think hunter-gatherers. And that’s just the human part of the brain.

There are too many aspects to this development to cover here. One day someone will write a book, or rather, many someones will write many books, and they will all be different. Some will focus on people’s lives being saved because their smartphones allow them to either receive or send out distress signals. Others will tell stories of teenagers committing suicide after being heckled on ‘social’ media. With yin comes yang. Millions feel better with new-found ‘friends’, and millions suffer from abuse even if they don’t kill themselves.

 

With new media, especially when it goes from 1 to 100 in no time flat, it should be no surprise that the news it delivers changes too. We went from a few dozen TV- and radio stations and newspapers to a few hundred million potential opinions in the US alone. The media are no longer a one-way street. The first effect that has had is that the chasm between news and opinion has narrowed spectacularly. If their readers post their views of what they read and see, journalists feel they have the right to vent their opinions too.

And then these opinions increasingly replace the news itself. The medium is again the message, in a way, a novel kind of way. A hundred million people write things without being restricted by due diligence or other journalistic standards, and we see journalists do that too. They will come up with lies, half-truths, innuendo, false accusations, and moreover will not retract or correct them, except when really hard-pressed. After all, who has the time when you post a hundred+ tweets a day and need to update your Facebook pages too?

Obviously, Donald Trump is an excellent example of the changing media environment. His use of Twitter was a major factor in his election victory. And then his detractors took to Twitter to launch a huge campaign accusing him of collusion with Russia to achieve that victory. They did this moving in lockstep with Bob Mueller’s investigation of that collusion accusation. But almost two years after the election, neither Mueller not the media have provided any evidence of collusion.

That, ironically, is the only thing that is actually true about the entire narrative at this point. Sure, Mueller may still have something left in his back pocket, but if he had solid proof he would have been obliged to present it. Collusion with a foreign government is too serious not to reveal evidence of. Therefore, it’s safe to conclude that in September 2018, Mueller has no such evidence. But what about the thousands of printed articles and the millions of Tweets and Facebook posts claiming collusion that were presented as true?

Funny you asked. What they prove is not collusion, but the changing media landscape. The anti-Trump echo-chamber that I’ve written about many times has been going strong for two years and shows no signs of abating. There are still lots of people posting a hundred (re-)tweets etc. daily who are being read by many others, all of them confirming their biases in a never fulfilled feeding frenzy.

This is not about Trump. And I’m not a Trump supporter. This is instead about the media, and the humongous difference interactivity has made. And about the fact that it hasn’t just added a hundred million voices, it has also altered the way traditional media report the news, in an effort to keep up with those hundred million.

 

The thing here that is about Trump, is that he’s everybody’s favorite meal ticket. He confirms everyone’s opinion, whether for or against him, by the way he uses media. And most importantly, they all make a lot of money off of him. The New York Times and WaPo and MSNBC would be in deep financial trouble without Trump. Like they were before he came along. Polarization of opinions saved them. Well, not the WaPo, Jeff Bezos can afford to run 1000 papers like that and lose money hand over fist. But for the NYT and many others a Trump impeachment would be disastrous. Funny, right?

Another thing that is obvious is that one thing still sells above all others: sex. The smear campaign against Julian Assange has been successful in one way only, and it’s been a smash hit: the rape allegations. Completely false, entirely made up, dragged out as long as possible, and turning millions, especially women, against him.

The accusations against Supreme Court candidate Brett Kavanaugh haven’t been around long enough to be discredited. Maybe they will be, maybe they won’t. But read through newspaper articles, watch TV shows, follow Twitter, and you see countless voices already convinced ‘he did it’. And that ‘it’ is often labeled ‘rape’, though that’s not the accusation.

But it’s part of the Anti-Trump train, and the echo-chamber has gone into overdrive once again. Even if everyone understands that a 36-year old accusation must be handled with care. The accusing woman’s lawyer says the FBI must investigate, and everyone says: FBI! FBI!. Conveniently forgetting that the FBI has been far from impartial with regards to Trump, and the White House is not exactly waiting for another FBI role.

What’s wrong with waiting till you know the facts? Why judge a situation you know nothing about other than a woman accuses a man of assault 36 years ago, and doesn’t remember time, location etc.?

 

And that’s the thing all along, isn’t it? That people, both readers and journalists, all 200 million Americans of them, think they have acquired the right to judge any person, any situation they read a few lines about, just because they have purchased a smartphone. A faulty notion fed on a daily basis by the fact there are millions who think just like them.

We may want to rethink the terms ‘social’ media and ‘smart’ phone. They sound good, but they don’t cover the true nature of either. It’s hard to say where all this is going, but the sharply increasing polarization of society is certainly not a good sign. People feeling they have the right to accuse others without knowing facts, people building a Russiagate narrative without evidence, these are not things a society should welcome, whether they’re profitable or not.

Meanwhile, there are two people (there are many more, of course) who were banned from the platforms so many others use to draw baseless conclusions and spout empty accusations. And we miss them both, or we should: Alex Jones and Julian Assange. Have they really used ‘social’ media in worse ways than those 200 million Americans? Or were they banned because millions of Americans were following and reading their non-mainstream views?

We better get a grip on this, and on ourselves, or we won’t get another chance. What we have seen so far is that it’s not that hard to shape people’s opinions in a world with information overload. And that process is about to get a whole lot more intense. Until all you’re left with is the illusion that your opinion is actually your own.
